CASE #: [ <br /> <br />REQUEST FOR EXTENSION FOR VARIANCE FROM STREET FRONTAGE/ <br />LOT WIDTH REQUIREMENTS; <br /> CASE OF KELLY AND CARRIE HEMP <br /> By: Patrick Trudgeon, Principal Planner <br /> <br />Background: <br /> <br />On September 10, 2001, Kelly and Carrie Hemp were granted a variance by the Board of <br />Adjustment from the minimum lot width or street frontage requirement in order to construct a <br />dwelling on a parcel that they purchased from Megan Roche. One of the conditions of the variance <br />was that work would be started within one year of the granting of the variance. Staff' recently <br />learned that they have not pulled a building permit to construct a home on the lot, The applicants <br />are asking for a one-year extension to their variance. The subject property is located on the south <br />side of County Road #64 (181st St.) <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br />g) <br /> <br />Site location map <br />Letter requesting extension dated November 12, 2002 <br />Cerificate of Survey <br />Board of Adjustment Minutes dated September 4, 2001 <br />Adopted Findings of Facts <br />Adopted Variance <br />Proposed resolution granting extension of initiation of variance <br /> <br />Observations: <br /> <br />The parcel is approximately 21.20 acres in size and is zoned R-1 Residential. The parcel on which <br />the variance was granted was an existing lot, but under strict interpretation of the code, a dwelling <br />could not constructed on the property since it was deficient in lot width. <br /> <br />On Septermber 10, 2002 the Boad of Adjustment granted the variance subject to certain conditions. <br />Under Section 9.03.05 (5) of City Codes, variances expire one year from the granting of the request <br />by the Boards of Adjustment. City Code does allow for an applicant to request an extension of time <br />to institute the variance. <br /> <br />Staff has reviewed the request from the applicants and find that it is acceptable for the City to grant <br />the extension to the variance. <br /> <br />Recommendation: <br /> <br />City Staff recommends extending the time period to implement the variance from street frontage and <br />lot width requirements granted to Kelly and Carrie Hemp until September 10, 2002. <br /> <br /> <br />
