5. POLICY BOARD BUSINESS <br />5.01: Recommend Resolutions #16-01-005, #16-01-006, #16-01-007, and #16-01-008 <br />Related to a Request for a Variance to Minimum Lot Size, Width and Side Yard <br />Setbacks in the Critical River Overlay District on the Properties Located at 14510 <br />and 14500 Bowers Drive NW; Case of Central Bank <br />City Planner Anderson presented the staff report. He noted the house has been on this property <br />for decades, dating back to about 1970 and there is no record of a building permit. Since then, the <br />City has incorporated and the Critical River Overly District standards have been implemented, <br />which results in some non -conformities. <br />Board Member Lewis inquired what the width of the remaining lot size would be if the common <br />lot line was adjusted. <br />City Planner Anderson responded the reduction in width would change from 100 feet to 80 feet. <br />Board Member Lewis questioned if this would be large enough for a home. <br />City Planner Anderson explained the home would likely be placed within the same setback pattern. <br />The builders would likely need to request a variance for the setback to the ordinary high water <br />mark. He said he believes an 80 foot width would be possible. He added that where it would line <br />up with the other homes could be an issue. <br />Board Member Lewis clarified there would still be 100 feet of footage on both the front and the <br />back. <br />City Planner Anderson confirmed this. <br />Board Member Lewis asked whether this lot line adjustment includes the driveway. He pointed <br />out if the common lot line adjustment occurs, there is a condition of including the driveway in the <br />land transaction. He asked if the driveway would be in compliance if the encroaching section is <br />removed. <br />City Planner Anderson stated as part of correcting this encroachment, today's standard of a 5-foot <br />setback should be met. <br />Councilmember LeTourneau asked whether the home is across the property line, or whether just <br />the deck is. <br />City Planner Anderson explained a small sliver of the home is on the other property. The owner <br />would have to modify the home and remove the decks to meet the standard of the 10-foot setback. <br />This would be a huge disturbance. The home has been there roughly 45 years. There is evidence <br />of a deck and reference to it going back to 1981. He said this current owner just became an owner <br />of the lot and would like to bring it into compliance. It is in the Critical River Overlay District, <br />which is why this item is coming to this Board, as this. process would increase the non -conformity <br />related to lot area. <br />Environmental Policy Board / December 21, 2015 <br />Page 2 of 6 <br />
