Councilmember Kuzma introduced the following resolution and moved for its adoption: RESOLUTION #17-07-171 RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR A DECK TO BE PARTIALLY LOCATED IN A DRAINAGE AND UTILITY EASEMENT ON THE TH PROPERTY GENERALLY KNOWN AS 7042 167 CROSSING NW AND DECLARING TERMS OF SAME WHEREAS, Cory and Holly Steinbach, hereinafter referred to as the “Applicant,” have requested an Encroachment Agreement to allow a 12’ x 20’ deck (the “Deck”) to be partially located in a drainage and utility easement (the “Easement”) on the property legally described as follows: th Lot 4, Block 4 Brookfield 7 Addition (the “Subject Property”). WHEREAS, the Applicant applied for a Building Permit to construct the Deck on the Subject Property; and WHEREAS , the Deck will partially encroach into the Easement; and WHEREAS , Engineering Department has found that the Easement can still function with the encroachment of the Deck; and WHEREAS , City Council reviewed the Encroachment Agreement request on July 11, 2017. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1.That, contingent upon the Applicant entering into an Encroachment Agreement with the City and recording said agreement against the Subject Property, the Applicant may construct and maintain the Deck in accordance with the terms and conditions contained within the Encroachment Agreement. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Johns, and upon vote being taken thereon, the following voted in favor thereof: Mayor Strommen Councilmember Kuzma Councilmember Johns Councilmember LeTourneau Councilmember Riley Councilmember Shryock Councilmember Williams
