CC Regular Session <br />Meeting Date: 07/25/2017 <br />Submitted For: Tim Gladhill, Community Development <br />By: Eric Maass, Community Development <br />4. 6. <br />Information <br />Title <br />Adopt Resolution #17-07-178 Approving an Encroachment Agreement for a Deck to be Partially Located within a <br />Drainage and Utility Easement at 7190 167th Terrace NW; Case of Justin and Amanda Hora <br />Purpose/Background: <br />The City recently received a Building Permit Application for a deck to be constructed at 7190 167th Terrace NW <br />(the "Subject Property"). There is only about five (5) feet between the rear wall of the home and a drainage and <br />utility easement (the "Easement"). Based on the proximity of the home to the Easement, there are not really any <br />viable alternatives for a deck that would not result in an encroachment. <br />Notification: <br />Notification is not required when considering an Encroachment Agreement. <br />Observations/Alternatives: <br />The proposed deck is thirteen (13) feet in depth and thirty-two (32) feet wide, with a three (3) foot wide stairway <br />down to the ground which is included in the thirteen (13) foot depth measurement. While a portion of the deck and <br />stairway encroach into the Easement, it would not have any impact on drainage and there are no public utilities <br />such as storm sewer, sanitary sewer, or municipal water infrastructure within the Easement either. The Engineering <br />Department has reviewed this request and has no objection to the Encroachment Agreement. <br />Funding Source: <br />All costs associated with this request are the Applicant's responsibility. <br />Recommendation: <br />Staff recommends approving the Encroachment Agreement to allow a deck to be partially located within the <br />Easement on the Subject Property. <br />Action: <br />Motion to adopt Resolution #17-07-178 approving an Encroachment Agreement between the City and Property <br />Owner for a deck to partially encroach into the Easement on the Subject Property. <br />Site Location Map <br />Updated Site Plan <br />Encroachment Agreement <br />Resolution #17-07-178 <br />Attachments <br />Form Review <br />Inbox Reviewed By Date <br />Chris Anderson Chris Anderson 07/19/2017 12:07 PM <br />
