CC Regular Session 4. 10. <br />Meeting Date: 07/11/2017 <br />By: Chris Anderson, Community <br />Development <br />Information <br />Title <br />Adiopt Resolution #17-07-171 Approving an Encroachment Agreement for a Deck to be Partially Located within a <br />Drainage and Utility Easement at 7042 167th Crossing NW; Case of Holly and Cory Steinbach <br />Purpose/Background: <br />The City recently received a Building Permit Application for a deck to be constructed at 7042 167th Crossing NW <br />(the "Subject Property"). There is only about five (5) feet between the rear wall of the home and a drainage and <br />utility easement (the "Easement"). Based on the proximity of the home to the Easement, there are not really any <br />viable alternatives for a deck that would not result in an encroachment. <br />Notification: <br />Notification is not required when considering an Encroachment Agreement. <br />Observations/Alternatives: <br />The proposed deck is twelve (12) feet in depth and twenty (20) feet wide, with a four (4) foot wide stairway down <br />to the ground. While a portion of the deck and stairway encroach into the Easement, it would not have any impact <br />on drainage and there are no public utilities such as storm sewer, sanitary sewer, or municipal water infastructure <br />within the Easement either.
