ENCROACHMENT AGREEMENT <br />THIS AGREEMENT ("Agreement") is made this day of , 2017, by and <br />between the CITY OF RAMSEY, a municipal corporation under the laws of the State of <br />Minnesota ("City"), and Cory and Holly Steinbach, husband and wife, and their successors and <br />assigns ("Landowner"). <br />RECITALS: <br />WHEREAS, Landowner is the fee owner of the real property located at 7042 167rh <br />Crossing NW, Ramsey, Minnesota, and legally described as follows: <br />Lot 4, Block 4 Brookfield 7th Addition <br />("Property"); and <br />WHEREAS, the City currently has Drainage and Utility Easements ("Easements") over, <br />under and across a portion of the Property, as dedicated to the public pursuant to the Plat known <br />as "BROOKFIELD 7THADDITION" recorded in the Office of the County Recorder, Anoka <br />County, Minnesota; and <br />WHEREAS, Landowner seeks permission from the City to partially encroach upon the <br />Easements to construct a twelve foot by twenty foot (12' x 20') deck with a four (4) foot wide <br />stairway (together, the "Deck") off the rear wall of the home as shown on Exhibit "A". <br />1 <br />
