He noted the shed is inside the privacy fence which <br />is about one foot off the property line. <br /> <br />Chairperson Nixt asked what the setback is for a non-comer lot. <br /> <br />Community Development Director Frolik stated the setback is six feet for an uninhabitable <br />accessory structure. <br /> <br />Mr. Graphenteen stated the garage is currently set back about four feet. <br /> <br />Chairperson Nixt noted there are unique topographical features as well as it being a comer lot. <br />He asked that the letters in support be included in the meeting minutes by reference as follows: <br /> <br />· Letter from Jim and Marilyn Prody stating their complete support of the setback variance. <br />· Letter from Bryan and Michelle Morton, 5510 146th Avenue NW, stating their support for <br /> the variance and indicating it in no way causes a problem with the surrounding houses in the <br /> neighborhood. <br />· Letter from Brian G. Evans, 14700 Fluorine Street, stating he lives adjacent to the applicant <br /> and is very much in support of the variance since the shed poses no threat to him or any of his <br /> neighbors, and indicating to force Mr. Graphenteen to move the structure would be cruel and <br /> unusual. <br />· Letter from John Schievschmidt, mailman, stating he was standing next to Kevin <br /> Graphenteen when City staff told him to keep his shed a little off the property line. <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Kociscak, to close the public hearing. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Kociscak, Brauer, Johnson, <br />Reeve and Watson. Voting No: None. Absent: None. <br /> <br />The public hearing closed at 7:30 p.m. <br /> <br />Board Business <br /> <br />Chairperson Nixt called the Board of Adjustment meeting back to order at 7:30 p.m. <br /> <br />Chairperson Nixt stated his willingness to consider relief for this applicant due to the number of <br />letters of support <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Johnson, to adopt Resolution #02-11o <br />282 adopting Findings of Fact #0637 in support of Kevin and Christine Graphenteen's request <br />for a variance on the property located at 14670 Fluorine Street NW, based on the findings of fact <br />favorable to the applicant. <br /> <br />Board of Adjustment/November 7, 2002 <br /> Page 6 of 7 <br /> <br /> <br />
