Absent: Board Members Brauer and Watson. <br /> <br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Variance to the Front Yard Setback and to Construct an <br />Accessory Structure Closer to the Front Property Line than the Principal <br />Structure; Case of Mike and Cindi Heying <br /> <br />Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:10 p.m. in <br />order to conduct the public hearing. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 7:10 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik explained that Section 9.20.11 of the Ramsey City <br />Code states that for lots zoned as R-1 Single Family (Rural Developing), the front yard setback <br />shall be 40 feet; and Section 9.11.02 states that no accessory structure shall be constructed closer <br />to the front property line than the principal structure. Mr. and Mrs. Heying are proposing to <br />construct an accessory building with a front yard setback of 33 feet (resulting in the accessory <br />structure resting seven feet closer to the front property line than the principal structure) on the <br />property located at 17211 Willemite Street NW. The site plan submitted reveals that there are <br />several constraints on the property restricting the applicants from meeting the front yard setback. <br />On the north end of the property, there is a 75-foot Northern States Power Company easement <br />for transmission lines. A drain field and alternative septic location are located on the east side of <br />the principal dwelling. Furthermore, there are a number of mature trees on the property and their <br />locations also are limiting the placement of an accessory structure. The Heyings are very <br />concerned with preserving the existing mature trees on their property. The Heyings had <br />originally requested a 25-foot variance (resulting in a 15-foot front yard setback). After an on- <br />site meeting with Staff, they reconfigured the layout of the building and were able to reduce their <br />request to a 7-foot variance (resulting in a 33 foot front yard setback).
