Councilmember LeTourneau introduced the following resolution and moved for its adoption: RESOLUTION #17-08-203 RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR A FENCE TO PARTIALLY ENCROACH INTO A DRAINAGE AND UTILITY EASEMENT ON THE th PROPERTY GENERALLY KNOWN AS 7066 167 CROSSING NW AND DECLARING TERMS OF SAME WHEREAS, Jeremy and Melissa Tovsen, hereinafter referred to as the “Applicant,” have requested an Encroachment Agreement to allow a four (4) foot tall chain link fence (the “Fence”) to be partially located in a drainage and utility easement (the “Easement”) on the property legally described as follows: Lot 2, Block 4 BROOKFIELD SEVENTH ADDITION (the “Subject Property”). WHEREAS, the Applicant applied for a Zoning Permit to construct the Fence on the Subject Property; and WHEREAS , the Fence will partially encroach into the Easement; and WHEREAS , the Engineering Department has found that the Easement can still function with the encroachment of the Fence. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1.That, contingent upon the Applicant entering into an Encroachment Agreement with the City and recording said agreement against the Subject Property, the Applicant may construct and maintain the Fence in accordance with the terms and conditions contained within the Encroachment Agreement. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Johns, and upon vote being taken thereon, the following voted in favor thereof: Mayor Strommen Councilmember LeTourneau Councilmember Johns Councilmember Kuzma Councilmember Riley Councilmember Shryock Councilmember Williams
