<br />Councilmember LeTourneau introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #17-08-203 <br /> <br />RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR A FENCE TO <br />PARTIALLY ENCROACH INTO A DRAINAGE AND UTILITY EASEMENT ON THE <br />th <br />PROPERTY GENERALLY KNOWN AS 7066 167 CROSSING NW AND DECLARING <br />TERMS OF SAME <br /> <br /> WHEREAS, <br /> Jeremy and Melissa Tovsen, hereinafter referred to as the “Applicant,” have <br />requested an Encroachment Agreement to allow a four (4) foot tall chain link fence (the “Fence”) <br />to be partially located in a drainage and utility easement (the “Easement”) on the property legally <br />described as follows: <br /> <br />Lot 2, Block 4 BROOKFIELD SEVENTH ADDITION <br /> <br />(the “Subject Property”). <br /> <br />WHEREAS, <br /> the Applicant applied for a Zoning Permit to construct the Fence on the <br />Subject Property; and <br /> <br />WHEREAS <br /> , the Fence will partially encroach into the Easement; and <br /> <br />WHEREAS <br />, the Engineering Department has found that the Easement can still function <br />with the encroachment of the Fence. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> <br /> <br />1.That, contingent upon the Applicant entering into an Encroachment Agreement with the City <br />and recording said agreement against the Subject Property, the Applicant may construct and <br />maintain the Fence in accordance with the terms and conditions contained within the <br />Encroachment Agreement. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Johns, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Strommen <br /> Councilmember LeTourneau <br /> Councilmember Johns <br /> Councilmember Kuzma <br /> Councilmember Riley <br /> Councilmember Shryock <br /> Councilmember Williams <br /> <br /> <br /> <br /> <br />
