D/B/A Penalty Box Grill, 14077 St. Francis Boulevard NW, Ramsey <br />Purpose/Background: <br />Purpose: To hold a public hearing on a liquor license request and finally authorize same for SM Enterprises Corp., <br />D/B.A Penalty Box Grill. <br />Background: SM Enterprises Corp., Mr. Shawn McManus and Mr. Edward Witschen d/b/a Penalty Box Grill, have <br />properly applied for an on -sale, Sunday and 2:00 a.m. intoxicating liquor license at 14077 St. Francis Boulevard <br />NW. This establishment is not a new liquor establishment and was most recently licensed under S & D <br />Management, Inc. d/b/a Penalty Box Bar and Grill. Due to some lease issues, the liquor license was not renewed on <br />July 1, 2017, for Deborah Danielson, S & D Management, Inc. The Penalty Box closed its doors as of that date. <br />Mr. McManus has since filed a new corporation with the Minnesota Secretary of State, and has applied to the City <br />of Ramsey for a liquor license under the new corporation. All licensing fees have been paid ($5,000 for on sale, <br />$200 for Sunday Sales and $300 for 2:00 a.m. Sales) and the public hearing was noticed in theAnoka County Union <br />Herald. Staff has received copies of a signed 10-year lease agreement between tenant Shawn McManus and <br />property owner Rivers Bend Plaza, LLC. The new corporation name of SM Enterprises Corp. will be incorporated <br />into the lease agreement prior to sending this license information to the State of Minnesota. <br />Police Chief Katers has completed the background investigations for both Mr. McManus and Mr. Witschen and <br />reviewed the application and found everything to be in order. <br />It is anticipated that Mr. McManus and/or Mr. Witschen will be present at the hearing. The City Clerk will not be in <br />attendance; therfore, Assistant City Administrator Patrick Brama will be presenting the case to Council. <br />Notification: <br />Notice of the public hearing was published in the Anoka County Union -Herald on Friday, August 25, 2017. <br />Recommendation: <br />Staff is recommending Council approve an on -sale, Sunday and 2:00 a.m. intoxicating liquor license for SM <br />Enterprises Corp., d/b/a Penalty Box Grill. <br />Action: <br />Motion to approve an on -sale, Sunday and 2:00 a.m. intoxicating liquor license for SM Enterprises Corp., d/b/a <br />Penalty Box Grill. <br />
