Motion by Chairperson Nixt, seconded by Commissioner Jeffrey to approve the following <br />minutes as amended: <br /> <br />1 ) Planning Commission public hearing and regular meeting minutes dated August 5, 2004. <br /> <br />Motion carried. Absent: None. <br /> <br />NOTE CITY COUNCIL MINUTES <br /> <br />1) City Council regular meeting minutes dated July 13, 2004 <br />2) City Council regular meeting minutes dated July 27, 2004 <br /> <br />Chairperson Nixt noted the City Council minutes. <br /> <br />PUBLIC HEARINGS/COMMISSION BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Conditional Use Permit to Exceed the Allotted Square Footage <br />for Accessory Buildings; Case of Michael Mettler <br /> <br />Presentation <br />Community Development Director Frolik advised the subject property is approximately 1.73 <br />acres in size and is located inside the Metropolitan Urban Service Area. She indicated that <br />according to City Code, the property is eligible for 1,664 square feet of accessory building space. <br />She stated there is currently a one-stall garage, which is 308 square feet, and a detached garage <br />which is 660 square feet on the subject property. <br /> <br />Community Development Director Frolik explained the applicant is proposing to construct an <br />addition on the detached garage that would be 960 square feet. She stated including the proposed <br />addition, there would be 1,928 square feet of accessory building space on the property, which <br />results in an overage of 264 square feet. <br /> <br />Community Development Director Frolik stated the applicant has stated that he plans to convert <br />the one-stall attached garage into living space, although that work would not occur for several <br />years. The applicant would like to exceed the size restriction in order to construct an addition on <br />the detached garage that would provide for more inside storage of private use vehicles and <br />equipment. <br /> <br />Chairperson Nixt noted Staff received three letters from residents opposed to this Conditional <br />Use Permit. <br /> <br />Community Development Director Frolik stated the residents are opposed to the oversized <br />building, which they believe will be used for commercial activity. <br /> <br />Planning Commission/September 2, 2004 <br /> Page 2 of 14 <br /> <br /> <br />
