CASE <br /> <br />CONSIDER OFFER TO PURCHASE DRAINAGE AND UTILITY EASEMENT <br />FROM LOT 1, BLOCK 3 WHITE PINE ESTATES <br /> By: Steven Jankowski, City Engineer <br /> <br />Background: <br /> <br />The City recently completed Improvement Project #04-24 Which con'ected a drainage <br />problem which had existed in the vicinity of 169th Avenue and Helium Street. In order to <br />facilitate this project it was necessary to obtain a drainage and utility easement along the <br />northerly property line of Lot 1, Block 3, White Pines Estates. The property owners of <br />this parcel signed a Right of Entry a=m'eement to allow this project to prOceed while an <br />appraisal of the value of the easement could be established. An appraisal has been <br />prepared by Malcolm Watson of Watson Appraisal and Consulting Service. Mr. Watson <br />has established the value of the easement at $5,200. Portions of the appraisal are attached <br />to this case. <br /> <br />Recommendation: <br /> <br />In accordance with City policy for acquiring property, which have been patterned after <br />state law for property takings for transportation projects, staff recommends that the City <br />transmit a copy of the appraisal to the property owners for their review, advise them that <br />they have the right to obtain a second appraisal and be reimbursed for this appraisal at an <br />amount not to exceed $1,500, and to offer to purchase the easement for the appraised <br />amount of $5,200. <br /> <br />Action: <br /> <br />Motion to recommend to City Council that the City transmit a copy of the appraisal to the <br />property owners for their review, advise them that they have the fight to obtain a second <br />appraisal and be reimbursed for tlfis appraisal at an amount not to exceed $1,500, and to <br />offer to purchase the easement for the appraised amount of $5,200. <br /> <br />Reviewed By: <br />Director of Pnblic Works/Fire Chief <br />Assistant Public Works Director/Principal Engineer <br />Cily Attorney <br /> <br />PW: 11/16/04 <br /> <br />55 <br /> <br /> <br />
