Councilmember introduced the folloWing resolution and moved for its adoption: RESOLUTION #04-11- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO RAMDANCE, LLC TO CONSTRUCT A BUILDING LARGER THAN 35,000 SQUARE FEET IN THE TC-2 ZONING DISTRICT AND DECLARING TERMS OF SAME: WHEREAS, Ramdance LLC, hereinafter referred to as the "Applicant," has properly applied for a Conditional Use Permit to construct a building larger than 35,000 square feet in the TC-2 Zoning District on property legally described as follows: Outlot l, Ramsey Town Center Addition, Anoka County, Minnesota (~'S ubject Property") WHEREAS, the Planning Commission met on November 4, 2004, conducted the public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That based on Findings of Fact #0__, a Conditional Use permit (Permit) to Construct a building larger than 35,000 square feet in the TC-2 Zoning District, is hereby granted to Ramdance, LLC, hereinafter referred to as the "Permittee". That this Permit shall only apply to the grocery store building to be located on the Subject Property, which is proposed to be platted as Lot 1, Block 1, Ramsey Town Center 3rd Addition. That in accordance with the final site plan approved by City Council on October 12, 2004, this Permit shall allow for the initial development of a 62,000 square foot grocery store building. 4. That this Permit shall also allow for future expansions of the grocery store and the maximum building size (fbotprint) is established at 70,000 square feet. 5. That any future expansions of the grocery store building are subject to site plan approval from the City Council. That the grocery store building shall be properly constructed and maintained in accordance with all applicable Staff Review letters, approved site plans, City Code, and Uniform Building Codes.
