WHEREAS, on August 24, 2004, pursuant to Resolution #04-11- , the CITY <br />approved the final plat of the Subject Property which plat is known as ROWE ADDITION (the <br />"Plat") contingent on certain requirements, including DEVELOPER and' CITY entering into <br />this agreement; and <br /> <br />WHEREAS, the Plat consists of one existing, developed residential lot; and <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section. 9.50.03 entitled "Minor Subdivision"; and <br /> <br /> WHEREAS, no expenditure of CITY funds will be made Until City Code escrow <br />requirements have been fulfilled by the DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />SECTION I. <br />IMPROVEMENTS <br /> <br />Access to Lots. Lot 1, Block 1, will continue to receive aCcess from Green Valley Road. <br /> <br />Drainage and Utility Easements. The standard drainage and utility easements shall be <br />dedicated along the perimeter of the lot. <br /> <br /> SECTION II. <br />PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in <br />the Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet <br />of the structure; (b) a Certificate of Survey, including that survey information required by <br />the CITY, has been supplied to the City Building Official upon his/her request; and (c) <br />all the financial guarantees required by the CITY have been satisfied. No occupancy <br />permit for any lot in the Plat shall be issued until: (a) all utilities are in place, operational <br />and accepted by the CITY; and (b) landscape trees, or escrow for same, has been <br />provided. <br /> <br /> SECTION III <br />PARKS, TRAILS, STORMWATER, LANDSCAPING <br /> <br />l'ark Dedication. The existing homestead on Lot 1, Block 1 is exempt from park <br />dedication requirements. <br /> <br /> <br />
