Chah'person Nixt noted if the property owner is allowed to develop an area now he has benefited <br />l?om the process. He then waits on the remainder of the land until sewer and water comes and <br />can then develop the remainder of the land. He would actually gain the raw land net of what the <br />City will take tbr normal infrastructure to allow him to develop those other units. <br /> <br />1Mr. Engstrom requested that the residents receive notification of any other meetings. <br /> <br />Chairperson Nixt questioned what staff is looking for from the Commission tonight. <br /> <br />Assistant Community Development Director , Trudgeon replied staff would like a <br />recommendation to the Council. He noted the moratorium expires September 12th. <br /> <br />Chairperson Nixt stated there have been some .meaningful comments tonight that need to be <br />considered and evaluated befbre the ordinance goes forward. <br /> <br />Assistant Community Development Director. Trudgeon indicated the Commission can have more <br />discussion il! they would like. He is a little worried about the expiration of the moratorium. He <br />explained a 90 day moratorium was instituted but this may be a bigger issue that takes more than <br />90 days. This discussion will likely be on the agenda of the August 24th City Council meeting. <br /> <br />Mr. Zaetsch suggested notice of meetings be posted on the City website. He stated the agenda <br />tbr this meeting was not emailed today. They found out about it through word of mouth from a <br />councilmember, and another councilmember did not know there would be a public hearing on <br />this issue. Notice did not get out. He stated there is also a problem with the turnaround on the <br />minutes. The last set of minutes available from the City is from July 3rd. <br /> <br />Assistant Community Development Director Trudgeon indicated staff went above and beyond <br />requirements by notifying property owners with five acres or more' and also running a notice in · <br />the newspaper. Staff would be more than happy to post it on the City website. He does not <br />know what happened with the Planning Commission agenda being emailed, but the Council is <br />aware ot' thc Planning Commission agendas. <br /> <br />Chairperson Nixt explained state law requires notification to be given to the people that are <br />logically most affected by the ordinance, and there are others that have interest in the ordinance. <br />The City will try to provide more notice to those not legally required. He noted there have been <br />a number o[" comments raised, and some practical ramifications associated with 'the concept. He <br />is not altogether concerned about the homeowners association. He asked if the City has thought <br />through the t'unctioning private systems and if the concept of clustering with private septic and <br />wells is practical and pragmatic. <br /> <br />Assistant Community Development Director Trudgeon replied there are a lot of other examples <br />in the metro area, it' not the nation, of cluster developments working. The key is to make sure <br />that the common septic system is monitored. It may require an escrow to put up by the <br />developer in the forefront for replacement of the system so there are sufficient funds if it does <br />t'ail.
