Councilmember __ introdnced the following resolution and moved for its adoption: RESOLUTION #04-12- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO RAMDANCE, LLC TO OPERATE A RESTAU1L4NT DRIVE-UP WINDOW AS PART OF THE. POND BUILDING IN IL.-kMSEY TOWN CENTER 3Rn ADDITION IN THE TC-2 ZONING DISTRICT AND DECLARING TERMS OF SAME: WHEREAS, Ramdance, LLC, hereinafter re[eh'ed to as the "Pemittee," has p[operly applied £or a Conditional Use Permit to operate a restaurant drive-up window as part o-1:' the Pond Building in Ramsey Town Center ? Addition in the TC-2 Zoning District on property, legally described as follows: Outlot l, Ramsey Town Center Addition. Anoka County, Mim~esota; Or upon recording Lot 1. Block 1, Ramsey Town Center 3~" Addition. CS ubj ect Property") WHEREAS, the Plamaing Commission met on December 2. 2004, conducted tiae public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF I~_MSEY, ANOtC:k COUNTY, STATE OF MINNESOTA, as follows: Based on Findings or' Fact #0 . a Conditioaal Use Permit (Permi0 to operate a restaurant drive-up window as part of' the Pond Building in Ramsey Town Center 3rd Addition in the TC-2 Zoning District..is hereby granted to the Permittee. That the Permit only applies to the drive-up window that will be a part of the Pond Building restaurants tO be located on the proposed Lot l, Block I of Ramsey Town Center ? Addition. 3. That the Permit only allows for the use of the drive-up window to support restanrant operations contained within the Pond Building. That the area of [he drive-up window shall only be located as sim,,¥n on the proposed site plan ~br the Pond Builciing.
