Councilmember Strommen clarified by having the development contract as one of the <br />contingeacies for this approval this can still be negotiated out. <br /> <br />Assistant Public Works Director Otson replied it is staff's intention now that they know they are <br />working on the master development agreement to work towards that. He hopes Shingobee <br />Development understands they will be negotiating how and if that gets paid back. <br /> <br />Representative of Shingobee stated he wants to be sure it gets 'addressed in the secondary <br />development agreement, which is contingent on this anyway and does not get settled right here.. <br /> <br />Assistant Public Works Director Olson indicated it will be in the secondary developrnent <br />agreement where they discuss how Zeolite Street gets built and who pays for it. Approval of this <br />is contingent to bringing back the secondary development agreement. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Pearson, to adopt Resolution <br />#04-10-313 to contingently approve the final plat of Ramsey Town center 3~d Addition. Voting No: None. <br /> <br />Case//9: <br /> <br />Request for Final Plat Approval of Coburn's Grocery, Ramsey Town Center <br />3r~ Addition Case of Ramdance, LLC <br /> <br />Community Development Director Frolik stated Ramdance, LLC has submitted a final site plan <br />for approval for the development of a Coburn's grocery store .on Outlot I of Ramsey Town <br />Center, proposed to be replatted as Lot 1', Ramsey Town Center 3rd Additiom The preliminary <br />site plan approved in July proposed a 54,000 square foot ~'ocery store. The final site plan <br />indicates that the store size has increased to 62,000 square feet. In accordance with the TC-2 <br />district regulations, the City issued a Conditional Use Permit to allow the gocery store to exceed <br />the 35,000 square foot maxim.urn. The Conditional Use Permit- allows development of a store up <br />to 63,000 square feet in size. The initial development at 62,000 square feet complies with the <br />terms of the CUP. However, it is staff's understanding that Coburn's may desire future <br />expansions up to 70,000 square feet. This requires a CUP amendment, which is expected to be <br />placed on the November Planning Cmmnission agenda. <br /> <br />Community Development Director Frolik explained one of the features of the grocery store is the <br />drive-thru pharmacy. In accordance with the TC-2 District regulations, the applicants did apply <br />for and obtain a Conditional Use Permit for the drive-thru window. The second amenity <br />associated with the groce~T store is the sale of motor fuel. Fuel sales are currently not a <br />permitted use in the TC-2 District. The applicant applied for a zoning amendment to allow gas <br />sales as an accesso~2¢ use in the TC-2 District.
