P54 <br /> <br />Case #4: Consider Resolution Approving the Appraisal of Damages for the <br /> Acquisition of Permanent Easements for Street, Drainage and Utility <br /> Purposes for the Extension of 160th Lane NW <br /> <br />City Attorney Goodl-ich reviewed that the Council authorized the commencement of eminent <br />domain action for the purpose of acquiring right-of-way for the extension of 160'~' Lane NW. As <br />part of that action, an appraisal of the damages each of the affected parcels will suffer as a result <br />of the taking has been completed. The City's appraiser has dete~Tnined that the dollar value of <br />damages to the Kaa5 parcel is $19,700.00 and the dollar value of the damages to the Dusbabek <br />parcel is $15,100.00. The Court procedure requires that the Council approve the appraisal and <br />adopt the proposed resolution. <br /> <br />Councihnember Kural( inquired of the stares on reaching a resolution with this situation. <br /> <br />City Attorney Goodrich replied the property owners have retained an attorney and have not had <br />an appraisal completed to date. Staff cam:ot negotiate with them until that is completed. <br /> <br />Motion by Councihnember Pearson, seconded by Councitmember Cook, to adopt Resolution <br />#04-10-327 approving the appraisal of damages for the acquisition of permanent easement for <br />street, drainage and utility proposes for the extension of 160"' Lane NW. <br /> <br />Motion canSed. Voting Yes: Mayor Gamec, Councilmembers Pearson, Cook, and Strommen. <br />Voting No: Councilmembers Kurak and Zimmen-nan. Absent: Councitmember Elvig. <br /> <br />Case #5: <br /> <br />Request for Approval of the Development Contract for the Final Plat of <br />Ra~nsey Town Center 3~ Addition; Case of Ramdance LLC <br /> <br />Community Development Director Frolik indicated Ramdance LLC has requested Case 5, 6 and <br />7 be tabled. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Strommen, to table the request <br />for approval of the development contract for the final plat of Ramsey Town Center 3~d Addition, <br />Case of Ramdance, LLC; to table the requests for approval of the development permit relating to <br />the final site plan for the development of Lot 1, Block 1, Ramsey Town Center 3~ Addition; <br />Case of Ramdance, LLC; and to table the adoption of an ordinance to vacate easement in <br />Ramsey Town Center Addition; Case of Ramsey Town Center LLC. <br /> <br />Further discussion: Councilmember Kurak inquired about the timeline on this project. <br />Co~mnnunity Development Director Frolik replied the anticipated opening is next fall. The tabled <br />cases will be able to be adopted at the next Council meeting. Mayor Gamec indicated Ramdance <br />felt they wanted to get some grading completed first, and these cases should be on the agenda of <br />the next meeting. They are counting on a December ground breaking. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councihnembers Cook, Strommen, Kurak, <br />Pearson, and Zimmerrnan. VotingNo: None.
