CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO OPERATE A <br />RESTAURANT DRIVE-UP WINDOW IN THE TC-2 ZONING DISRICT; <br />CASE OF RAMDANCE~ .L. LC <br /> By: Sylvia Frolik, Community. Development Director <br /> <br />Background: <br /> <br />Ramdance. LLC has a submitted site plan to construct a 9,200 square-fbot multi-tenant restaurant <br />facility in the Ramsev Town Center. The building is referred to as the Pond Building and is the <br />fourth and ~qnal building proposed ~'or Lot 1 of Ramsey Town Center 3rd Addition. The other 3 <br />buildings are Coborn's grocery store, Gateway Retail Building, and Comer Re'mil Buildingk The <br />site plan proposes to include a drive-up ~vindow for the convenience of itinerant customers. The <br />TC-2 District requires a Conditional Use Permit (CUP) for uses with a drive-thru feature. <br /> <br />The [bllowing items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site Plan <br />c) Proposed findings of fact <br />d) Proposed conditional use permit <br /> <br />Notification: <br /> <br />in accordance with State statute, Staff attempted to notify, owners of property within 350 feet of <br />the Subject Property o~' the applicant's request and the public hearing. <br /> <br />Observations: <br /> <br />The Ramsev Town Center project is designed to be a mixed-use, pedestrian friendly <br />development. Uses with drive-thrus have a potential tO be incompatible with the intent of the <br />Ramsev Town Center. Therefore, these types of uses are permitted only as a conditional use in <br />certain areas oi" the Town Center so that the may be reviewed for their compatibility. The TC-2 <br />Zoning District was created to accommodate larger scale, auto-orientated commercial activities. <br /> <br />.-ks previot~sly mentioned, the drive-tl~ru will function as part of the restaurant operations <br />cr>ntaim:d in the Pond Building. The drive-tln'u will be located on the south side of the building. <br />U,].~ drivc-thr,_t will have a dedicated lane ~br people to use to pick up flood orders. The users will <br />then circulate }x~cl< into the main parking area. City Staff has some concerns that the east side of <br />[he l'~.tte pt'..'oviding ',:l~e most direct access from Sunwood Drive to the ,genera! parking lot and the <br />&'ivo-t.~p win&ow anticipates parking vehicles along a main traffic lane. In addition, tl~ere are <br />s~mqc ct>nc¢rns Ibr tral;'~}c con~2icts in the parking lot where the drive-up window will be k~cated. <br /> <br /> <br />
