CASE # <br /> <br />REQUEST FOR A VARIANCE FROM MAXIMUM FRONT YARD SETBACK <br />REQUIRMENTS; CASE OF RAMDANCE LLC <br /> By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />Ramdance, LLC is proposing to develop Outlot I of Ramsey Town Center. The Planning <br />Commission and City Council recently approved the replat of Outlot I into Lots 1 and 2 of <br />Ramsey Town Center 3rd Addition. Phase 1 of Ramdance's development plan for Lot 1 included <br />the Coborn's grocery store, the Corner Retail Building, and the Gateway Retail Building. The. <br />City has received the preliminary site plan for Phase 2 which consists of the development of the <br />Pond Building, a multi-tenant restaurant facility that backs up to the pond on the west side of the <br />property. The following items are enclosed for your information: <br /> <br />a) Site location map c) <br />b) Site Plan d) <br /> <br />Proposed Resolution for Findings of Fact <br />Proposed Resolution for Variance <br /> <br />Observations: <br /> <br />The subject property is zoned TC-2 Town Center Commercial. Section 9.20.25 (3) (b) of City <br />Code establishes a minimum front yard setback of 0 feet and a maximum from yard setback of <br />15 feet. The Pond Building is proposed to be located approximately 180 feet from the from <br />property line. <br /> <br />The development plan for Phase 1 has always identified multiple buildings on Lot 1, two of <br />which would not be placed at the front property line. In August, the Board of Adjustment <br />granted the Applicant a variance to develop the property with multiple buildings. On October 12 <br />the City approved the final site plan for Phase 1 of the development, and that site plan affirmed <br />that there would be a future Pond Building that would not be placed at'the front property or at the <br />street. <br /> <br />Reco~nmcndation: <br /> <br />City Staff recommends approval of the variancel <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution #04-12-__ adopting Findings of Fact #__ relating to a request <br />fi'om P, amdance, LLC tbr a variance to maximum front yard setbacks for the proposed Pond <br />Building to bc constructed in the TC-2 Sub-District of the Ramsey Town Center. <br /> <br />-alld- <br /> <br />Motion to approve the request for a variance to maximum front yard setback requirements for <br />Ramdance, I2,C, based on the findings of fact, and adopt Resolution #04-12- declaring terms <br />t) ~' sanle. <br /> <br />Review C',hecldist: <br />Asst.
