Board Member introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-11- <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0. RELATING TO A REQUEST <br />FOR A VARIANCE TO THE MAXIMUM FRONT YARD SETBACK FOR THE <br />PROPOSED POND BUILDING IN THE TOWN CENTER ZONING DISTRICT, <br />S UBDISTRICT TC-2. <br /> <br /> WHEREAS, RAMDANCE, LLC, hereinafter referred to as "Applicant," has properly <br />applied for a variance fi'om Section 9.20.25, Subd. 3.b, regarding minimum and maximum front <br />yard setbacks in the TC~2 sub-district of the Town Center District, on the property legally <br />described as follows: <br /> <br />Outlot l, Ramsey Town Center Addition, Anoka County, Mim~esota <br /> <br />Or upon recording <br /> <br />Lot 1, Block 1, Ramsey Town Center 3rd Addition <br /> <br />(the "Subject Proper¢r) <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey Ci~' Code on December 2, 2004, and that said public hearing was properly <br />advertised, and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />2. That the Subject Property is zoned TC-2 Town Center Commercial and is approximately 9 <br /> acres in size. <br /> <br />3. That properties to the east, west, and north are zoned TC-2 Town Center Commercial. <br /> <br />4, That the Subject Property is bounded on the south by the Burlington Northern Santa Fe <br /> Raih'oad. <br /> <br />5. That section 9.20.25, Subd. 3.b, establishes a minimum front yard setback of 0 feet and a <br /> maximum structure setback of 15 feet. <br /> <br />That the Applicant is requesting a variance from the 15 foot maximum front yard setback in <br />order to construct a multi-tenant restaurant building on the Subject Property that will be <br />located approximately 180/:'eel fi'om the front Property line. <br /> <br />4 <br /> <br /> <br />
