Board Member introduced the following resolution and mOved for its adoption: RESOLUTION #04-12- A RESOLUTION APPROVING THE ISSUANCE. OF A VARIANCE TO THE lVlAXIMUM FRONT YARD SETBACK FOR THE PROPOSED POND BUILDING IN THE TOWN CENTER ZONING DISTRICT, SUBDISTRICT TC-2.AND DECLARING TERMS OF SAME. WHEREAS, RAMDANCE, LLC, hereinafter referred to as "Applicant," has properly applied for a variance from Section 9.20.25(3)(b) regarding maximum front yard setbacks in the TC-2 Sub-District of the Town Center District, on the property legally described as follows: Outlot l, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject Property); ~or upon recording: Lot 1, Block 1, Ramsey Town Center 3ra Addition (the "Subject Property") WHEREAS, the Board of Adjustment met on December 2, 2004, conducted the public hearing and adopted Findings of Fact relating to the Applicant's request for a variance from the maximum front yard setback requirements as part of the development of the Subject Property. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as folloWs Based on Resolution #04-12- adopting Findings of Fact #0 , a variance to the maximum front yard setback, as established in Section 9.20.25(3)(b) of the Ramsey City Code, is approved for the development of a multi-tenant restaurant building (the "Pond Building") on the Subject Property. That the placement of the Pond Building shall generally be in accordance with the Preliminary Site Plan prepared by URS dated November 10, 2004. The Permittee shall be responsible for all City costs incurred in processing the variance request.
