(c) That part of the north half of the northeast quarter of Section 1, Township 32, <br />Range 25, Anoka County, Minnesota described as follows: <br /> <br />Starting from the northeast corner of said section 1; thence south on the east line of said <br />section 1 a distance of 842.16 feet to the center line of public road; thence south 82 ½ <br />degrees west, on the center line of public road, to a point that is 400 feet westerly of the <br />east line when measured at right angles, this being the actual place of beginning; thence <br />north and parallel with the said east line of section 1 for a distance of 597 feet; thence <br />west and parallel with the north line of section 1 a distance of .07 feet more or less to the <br />east line of property previously conveyed to George W. Pierce and Grace M. Pierce on <br />12-21-61 and recorded 12-22-61 in book 543, page 571; thence south and parallel with <br />said east line of section 1 to said center line of public road; thence north 82 ½ degrees <br />east, along said center line to the place of beginning. <br /> <br />(Subject Property). <br /> <br /> AND WHEREAS, the Board of Adjustment conducted a public hearing on September <br />16, 2004, pursuant to Section 9.03.05 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That based on Findings of Fact #0699, a variance to construct a three-season porch within the <br />setback from the Ordinary High Water mark of Rogers Lake on the Subject Property is <br />hereby granted. <br /> <br />2. That the three-season porch addition cOnstructed on the Subject Property shall maintain a <br /> minimum setback of one hundred fifteen (115) feet from the Ordinary High Water mark. <br /> <br />3. That the exterior finish of the proposed addition shall match that of the principal structure, <br /> including soffit, fascia, and eave overhang. <br /> <br />4. That the Permittee shall be responsible for all costs incurred in administering and enforcing <br /> this variance. <br /> <br />5. That the Permittee shall obtain all necessary permits prior to COlnmencing any construction of <br /> the four-season porch addition. <br /> <br />6. That this Variance shall automatically expire if the use is not initiated by September 16, 2005 <br /> and issuance of the building permit shall constitute initiation. <br /> <br />RESOLUTION #04-09-277 <br /> Page 2 of 4 <br /> <br /> <br />
