Councilmember Cook introduced the following resolution and moved for its adoption: RESOLUTION #04-10-325 A RESOLUTION ADOPTING FINDINGS OF FACT #0704 RELATING TO A REQUEST FOR AN AMENDED CONDITIONAL USE PERMIT TO ALLOW AN ACCESSORY APARTMENT IN A SINGLE FAMILY STRUCTURE IN THE R-1 RESIDENTIAL DISTRICT WHEREAS, Kevin Block, Barbara Lee, and Gary Sandberg, hereinafter referred to as "Applicants", have properly applied for an amended Conditional Use Permit to allow an accessory apartment in a single family structure in the R-1 Residential District on the property generally known as 15823 Nowthen Blvd. NW and legally described as follows: That part of the Southwest Quarter of the Southwest Quarter of Section 14, Township 32, Range 25, Anoka County Minnesota described as follows: Commencing at the Southeast corner of said Southwest Quarter of the Southwest Quarter which point is the intersection of the South line of said Section 14 with the centerline of County State Aid Highway No. 5; Thence North 0 degrees 36 minutes 25 seconds West along said Centerline a distance of 224.10 feet; thence Northwesterly on a tangential curve to the left having a radius of 442.92 feet and having a delta angle of 37 degrees 57 minutes 15 seconds for a distance of 293.40 feet; Thence North 38 degrees 33 minutes 40 seconds West along said ccnterline and tangent to said curve a distance of 447.0 feet to the actual point of beginning of the tract of land to be hereby described; Thence continuing North 38 degrees 33 minutes 40 seconds West along said centerline a distance of 290.90 feet; Thence North 69 degrees 40 minutes 20 seconds East to its intersection with the East line of said Southwest Quarter of the Southwest Quarter; Thence Southerly along said East line to its intersection with a line having a bearing of North 89 degrees 42 minutes 50 seconds East and drawn from the actual point of beginning; Thence South 89 degrees 42 minutes 50 seconds West a distance of 360 feet, more or less, to the actual point of beginning (for the purpose of this description, the South line of said Section 14 is assumed to have a bearing of East and West.) (the "Subject Property"). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Applicants appeared before the Planning Commission for a public hearing pursuant to Section 9.03.05 of the Ramsey City Code on October 7, 2004, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 2. That the Subject Property is approximately four (4) acres in size. 3. That thc subject property is located in the R-1 Residential - Rural Developing District. That the surrounding parcels are zoned R-1 Residential - Rural Developing and that accessory apartments are not currently permitted as a conditional use in this zoning district. That according to Ramsey City Code Section 9.20.11, the R-1 Residential - Rural Developing District is intended for single family dwelling units.
