Starting from the northeast comer of said section 1; thence south on the east line of said <br />section 1 a distance of 842.16 feet to the center line of public road; thence south 82 ½ <br />degrees west, on the center line of public road, to a point that is 400 feet westerly of the <br />east line when measured at right angles, this being the actual place of beginning; thence <br />north and parallel with the said east line of section 1 for a distance of 597 feet; thence <br />west and parallel with the north line of section 1 a distance of.07 feet more or less to the <br />east line of property previously conveyed to George W. Pierce and Grace M. Pierce on <br />12~21-61 and recorded 12-22-61 in book 543, page 571; thence south and parallel with <br />said east line of section 1 to said center line of public road; thence north 82 ½ degrees <br />east, along said center line to the place of beginning. <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.07 of the Ramsey City Code on September 16, 2004, and that said public <br />hearing was properly advertised, and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br /> <br />That the Subject Property is zoned R-1 Rural Developing and is approximately 1.5 acre in <br />size. <br /> <br />3. That the Subject Property is surrounded by properties also zoned R-1 Rural Developing. <br /> <br />That the Subject Property is located within the Shoreland Overlay District of a Natural <br />Environment Lake (Rogers Lake) as defined in MN Rules. <br /> <br />That Section 9.21.04 (Shoreland Overlay District) of City Code establishes a structure <br />setback of 200 feet from the Ordinary High Water (OHW) mark of Rogers Lake. <br /> <br />That the principal structure on the Subject Property is located approximately one hundred <br />thirty (130) feet from the OHW mark of Rogers Lake. <br /> <br />That the Applicant is proposing to construct a 13'-8" x 12' three season porch addition on <br />the Subject Property that would be approximately one hundred seventeen (117) feet from <br />the OHW mark of Rogers Lake. <br /> <br />That the structure setbacks on neighboring properties are substantially less than the <br />Applicant's existing home after the proposed addition is constructed. <br /> <br />That additions to the Applicant's home are hampered by the close proximity between <br />Rogers Lake and 179th Lane NW. <br /> <br />RESOLUTION #04-09-276 <br /> Page 2 of 4 <br /> <br /> <br />
