N.W.' <br />Ramsey, MN 55303 <br /> <br />RE: <br /> <br />Wild and Scenic River Variance Certification, Richard Dahlman, 14750 Bowers Drive <br />NW, Mississippi River Critical Area/City ofRamsey, Anoka County <br /> <br />Dear Ms. Wald: <br /> <br />The Dcpartment of Natural Resources has reviewed the information you submitted regarding the <br />Richard Dahlman request for variance to'the lot area and width, and to the ordinary high water <br />level (OHW) setback. The Department received the review materials via fax on August 11 and <br />13, 2004. <br /> <br />City of Ramsey Resolution No. 04-08-__ is a pair of resolutions declaring findings of fact and <br />approving the issuance of the variance for Lot 5 and Lot 6 Bowers Mississippi Acres. The <br />variance allows a reduction of lot width, lot area, and structure setback from the ordinary high <br />water level. The findings of fact concluded that the subject parcels, consisting of Lot 5 and Lot 6 <br />were platted in 1948 with a width of 100 feet, are .55 and .67 acres respectively, and are both <br />owned by the applicant. The findings also concluded that similar variances allowing the separate <br />development of such parcels had been approved in the past. <br /> <br />Based on our review of the information submitted, and on behalf of the Conn'nissioner of Natural <br />Resources, [ hereby certify that the variance complies with the state Wild and Scenic Rivers Act <br />and Minnesota Rules, parts 6t05.0010 to 6105.0250 and 6105.0800 to 6105.0960. The action <br />t~tk~n by [i'~ Board of Adj ustmet',r is now legally ef.~ctive. <br /> <br />The Department is concerned that the development of these lots will necessitate significant tree <br />removal, especially on Lot 6. We are also concerned that the slopes on both lots at the building <br />sites are in excess of 12% (bluffiine). We urge the City to consider ways to mitigate these <br />problem, s before issuing any development permits. Therefore, we suggest the following actions: <br /> <br />Tree removal, especially on lot 6, will be significant.
