CASE # I <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO MAINTAIN A <br />COMMERCIAL VEHICLE LARGER THAN ONE TON IN A RESIDENTIAL <br />DISTRICT; CASE OF DAVID PEHLKE <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Section 9.11.10 (Off-Street Parking) of the Ramsey City Code states that no more than one 1-ton <br />motor vehicle bearing a commercial license shall be parked or stored in a residential district. David <br />Pehlke is starting his own septic system pumping service and is seeking City approval to store his <br />two-ton pumper track at his home. The subject property is one acre in size, however Mr. Pehlke <br />also owns the adjacent parcels to the north and south for a total of approximately 3 acres. Mr. <br />Pehlke does not have an accessory structure that would accommodate storing the track indoors. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map c) <br />b) Site plan d) <br /> <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Observations: <br /> <br />On January 18, 1991, the City of Ramsey received an application from David Pehlke for a <br />conditional use permit to maintain a commercial vehicle larger than one ton on his property. <br /> <br />A public heating regarding the request for a conditional use permit was scheduled for February 5, <br />1991. <br /> <br />There is one other similar permitted conditional use in the City. In 1989, the City issued a <br />conditional use permit for a firewood sales business in the Rural Residential District; the <br />conditional use permit included storing relating commercial vehicles on the property. <br /> <br />Recommendation: <br /> <br />There would appear to be no significant impact relating to Mr. Pehlke's request, however, the <br />recommendation of the Planning and Zoning Commission should be formulated following the <br />public hearing. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recommend that City Council adopt the proposed findings of fact relating to Mr. Pehlke's <br />request for a conditional use permit at 5566 152nd Avenue N.W. <br /> <br />-and- <br /> <br />Motion to: <br />Recommend that City Council approve/deny Mr. David Pehlke's request for a conditional <br />use permit to maintain a two-ton commercial vehicle on the property at 5566 152nd Avenue <br />N.W. <br /> <br />Review Checklist: <br />P&Z: 2/5/91 <br /> <br />Zoning Administrator <br /> <br /> <br />
