REVIEW <br /> <br />BUSINESS AND INDUSTRIAL ZONING <br /> By: Zoning Administrator Frolik <br /> <br /> CASE #3: <br />DISTRICTS <br /> <br />Background: <br /> <br />At the February 5, 1991 meeting of the Planning and Zoning Commission, it was noted that the <br />newly amended zoning districts contained an error. During the 1990 zoning amendment <br />discussions, the Planning and Zoning Commission recommended that exterior storage as an <br />accessory use to a principal permitted use should be a allowed and exterior storage as a principal <br />use of property should require a conditional use permit. This recommendation was aimed at the I-1 <br />Industrial, Rural Industrial and Business Warehouse Districts. <br /> <br />Observations: <br /> <br />The zoning amendments adopted by City Council state that exterior storage as an accessory use in <br />the Business Warehouse District is permitted provided it does not exceed 10% of the property and <br />exterior storage as a principal use of property requires a conditional use permit. In the I-1 <br />Industrial District, exterior storage as an accessory use is permitted and exterior storage as a <br />principal use requires a conditional use permit. In the Rural Industrial District, exterior storage as a <br />principal or accessory use of property requires a conditional use permit. <br /> <br />In reviewing the B-1, B-2 and B-3 Business Districts, I interpret the zoning ordinance to prohibit <br />exterior storage as a principal or accessory use of property. <br /> <br />A copy of all of the Business and Industrial District zoning regulations is enclosed for your review. <br /> <br />Recommendation: <br /> <br />Review the I-1 Industrial, Rural Industrial and Business Warehouse District zoning regulations to <br />determine if they meet the intent of the Planning and Zoning Commission's past recommendations. <br />If not, then the Planning and Zoning Commission should initiate an ordinance amendment. <br /> <br />I believe now is a good time for the Planning and Zoning Commission and Economic Development <br />Commission to become familiar with the new zoning regulations for all of the Business and <br />Industrial Districts. If there are any areas requiring amendments, those could be accomplished at <br />the same time ordinance amendments are initiated to clarify how and where exterior storage will be <br />allowed. <br /> <br />Commission Action: <br /> <br />Will be based on your discussion. <br /> <br />Review Checklist: Zoning Administrator <br />P&Z/EDC: 2/28/91 <br /> <br /> <br />
