CASE <br /> <br />DISCUSSION REGARDING SALVAGE ACTIVITY <br /> AT EAST LAKE AUTO, 7131 HWY. #10 N.W. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />At a recent meeting of the Planning and Zoning Commission, it was brought to the attention of the <br />Commission that there appears to be activity at East Lake Auto, 7131 Hwy. #10 N.W. (PIN 27-32- <br />25-33-0003) that could be defined as auto salvage. <br /> <br />Observations: <br /> <br />The subject property is zoned B-3 Business, for which auto repair is a permitted used. However, <br />the following excerpts from City Code clearly define and prohibit any auto salvage activity: <br /> <br />Section 9.02 of City Code defines "Junk Yard" as land or buildings where waste, discarded or <br />salvaged materials are bought, sold, stored, exchanged, cleared, packaged, disassembled or <br />handled. <br /> <br />Section 9.02 defines "Vehicle Wrecking Yard" as any place where two or more vehicles not in <br />running condition and/or not licensed, or parts thereof, are stored in the open or any land used for <br />wrecking or storing of such motor vehicles or parts thereof, and including any commercial <br />salvaging and scavenging of any other goods, articles or merchandise. <br /> <br />Section 9.11.02 states that the storage of two or more automobiles that do not have current license <br />plates constitutes an auto salvage business and shall not be permitted as an accessory use of <br />property. <br /> <br />Section 9.21.23 (B-3 Highway Business District) does not list auto salvage as a permitted use. <br /> <br />Section 9.03.10 of the City Code states that whenever in any zoning district a use is neither <br />specifically permitted or denied, the use shall be considered prohibited unless a conditional use <br />permit is applied for and granted. <br /> <br />Photos of the property will be available at the meeting. <br /> <br />Recommendation: <br /> <br />In my opinion, we have a clear violation of City Code and compliance should be pursued at the <br />direction of the Planning and Zoning Commission. <br /> <br />Commission Action: <br /> <br />Will be based on your discussion. <br /> <br />Review Checklist: <br /> <br />P&Z: 6/4/91 <br /> <br />Zoning Administrator <br />City Engineer <br />Community Development Inspector <br /> <br /> <br />
