CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ESTABLISH A FACILITY <br />FOR ~PROCESSING DEMOLITION ASPHALT AND CONCRETE INTO <br />AGGREGATE IN THE BUSINESS WAREHOUSE (BW) DISTRICT; <br /> CASE OF BURY AND .CARLSON, INC. <br /> By: Zoning Administrator Sylvia Frolik and City Engineer Steve Jankowski <br /> <br />Background: <br /> <br />Bury and Carlson, Inc. has submitted a request for a conditional use permit to establish a facility <br />for the purpose~ of processing demolition asphalt and concrete into aggregate for resale to <br />contractors., Approximately 25% of the operation would consist of retail sales of other <br />miscellaneouS landscaping supplies. The proposed location of the facility is east of Gateway North <br />Industrial Park at the intersection of 143rd Avenue N.W. and Jaspar Street N.W. The subject <br />property is zoned Business Warehouse (BW) and the 75% of the operation devoted to processing <br />demolition asphalt and concrete would be considered a heavy industrial use; therefore, the need for <br />the conditionlil use permit. <br /> <br />Although on the face of it, the application would appear to be subject to our regulations for solid <br />waste management facilities, it has been documented in previous cases that the City's position is <br />that recyclable materials are waste unless the material is being processed with a resulting new end <br />product of v~ue being produced on the site. <br /> <br />The stockpile heights are proposed to be limited to 32 feet in height. The applicant is proposing <br />that the total,amount of stockpiled rubble and aggregate permitted on the site be established at <br />250,000 cubic yards. It is estimated that in the first year of operation, there will be approximately <br />38 incoming !loa~ls of demolition debris and 38 outgoing loads of aggregate per day; the retails <br />sales from thc contractor supply yard is estimated at 10 incoming loads and 15 outgoing loads per <br />day. The applicant is anticipated that by the third year of operation and thereafter, there will be 58 <br />incoming loads of debris and 58 outgoing loads of aggregate per day. <br /> <br />The proposed, facility in Ramsey will be the fourth such site for Bury and Carlson. The other <br />facilities are located in Maple Grove, Bumsville and Minnetonka. Various members of City Staff, <br />the Planning 'and Zoning Commission and City Council toured the facilities in Burnsville and <br />Maple Grove, I contacted representatives from each of these cities. The site in Bumsville required <br />a conditionalJuse permit because it involved stockpiled material. Burnsville is very pleased with <br />Bury and Carlson's operating standards. The site in Maple Grove is a permitted use and they too <br />report no problems with Bury and Carlson. The site in Minnetonka is considered lawful non- <br />conforming and due to be phased out. Minnetonka staff reported that the minor problems that have <br />arose are attributable to urban type development encroaching on the site. <br /> <br />Naturally, the: concerns with an operation of this type are dust and noise. The facility is subject to <br />MPCA permitting and as such, MPCA will monitor dust and noise levels.
