CASE # 1 <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ESTABLISH <br />PROFESSIONAL OFFICES AND RETAIL SALES IN THE B-3 HIGHWAY <br />BUSINESS DISTRICT; CASE OF WILLIAM DUBATS <br /> By: Zoning Administrator Sylvia Frolik <br /> <br /> Background: <br /> <br />Mr. William Dubats has purchased the property at 6740 Hwy. #10 N.W., which is zoned B-3 <br />Highway Buain~ss. The property contains two structures, one of which was most recently <br />occupied bySmaU World Day Care Center and the other serves as enclosed storage space. In 1976 <br />and 1981, the~City of Ramsey issued conditional use permits to the subject property for various <br />· uses. All of,~e e~nditional uses, with the exception of the enclosed storage area, have gone void <br />due to discon~.inuance for 12 consecutive months or more. The applicant is intending to continue <br />leasing the ericlo~ed storage spaces in one of the structures but intends to lease the space in the <br />other structure fol' retail activity and professional offices. Professional offices and retail activity <br />are not permffted uses in the B-3 Highway Business District, therefore, Mr. Dubats has applied for <br />a conditional use permit. <br /> <br />The following items are enclosed for your review: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Site plan and application addendum <br />Proposed findings of fact <br />PrOposed conditional use permit <br /> <br />Observations: <br /> <br />There currently exists professional offices and retail activities in this B-3 Highway Business <br />District. Prior to November of 1990, property along Hwy. #10 was zoned B-1 Business, for <br />which professional offices and retail activity were permitted uses. Reasonably, some of the <br />properties developed with these uses but as a result of the City's rezoning, these pre-existing <br />professional ~fices and retail type businesses are currently considered lawful non-conforming. <br /> <br />In reviewing [he site plan, it has been determined that there is a sufficient amount of paved off- <br />street parking;area on site to meet City Code requirements for the uses proposed. <br /> <br />Recommendation: <br /> <br />City Staff recOmmends approval of the request. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recommend that City Council adopt a resolution declaring findings of fact relating to Mr. <br />Dubat~' request for a conditional use permit. <br /> <br />-and- <br /> <br />Motion to: <br />Recommend that City Council adopt a resolution approving the issuance of a conditional <br />use permit to Mr. William Dubats and declaring terms of same. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />City Engineer <br /> <br />P&Z: <br /> <br />10/6/92 <br /> <br /> <br />
