CASE #3: <br /> <br />PROPOSED REVISIONS TO B-3 HIGHWAY BUSINESS DISTRICT <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you recail, at your regular meeting on October 6 we discussed some needed revisions to the B-3 <br />Highway Bttsin~ss District regulations. Per your direction, I have enclosed a draft revision of the <br />B-3 District.! The additions to the district regulations are reflected in bold type and the deletions are <br />reflected with sffikeouts. <br /> <br />ObservatiOns: <br /> <br />Subdivision!2 (Permitted Uses) proposes to inclade 'enclosed retail sales and rental activity' and <br />'offices, banks, personal and professional services'. Items 'j' through 'n' are uses that our current <br />ordinance r .~ui/'es a conditional use permit for provided they met certain performance standards. I <br />have proposed to include these uses as permitted uses in this district and the standards for granting <br />a conditional use permit were incorporated into Subdivision 4 (Standards). If we have already <br />determined .that under certain development criteria these uses should be allowed with a conditional <br />use permit,, then why not list them as permitted uses and incorporate the criteria into the <br />performane~ standards. <br /> <br />Subdivision 3 (Accessory Uses) has been amended to allow outside storage (on a limited basis), <br />and outdoor~salCs, service, display and rental, as an accessory use of property versus requiring a <br />conditional use Permit. If we say motor vehicle sales, recreational equipment and implement sales <br />are permitted uSes, then I believe it is more reasonable to establish performance standards for these <br />outside displayS.areas than to require a conditional use permit for an activity so inherent to the <br />permitted u~e. ~In addition, the ability to use property principally for exterior storage with a <br />conditional UsePermit has been eliminated. In my opinion, using a parcel solely for exterior <br />storage purpOseS is not appropriate along the highway corridor. <br /> <br />Subdivision 4 (Standards) has been amended to include all of those items that are currently listed as <br />criteria for. various uses with a conditional use permit. A standard was also added to basically <br />require that any unused portion of a site is landscaped and maintained. <br /> <br />Subdivision 5 (Setbacks) was amended with some minor deletions. <br /> <br />Recommendation: <br /> <br />Direct Staff to make any additional amendments deemed appropriate and schedule a public hearing <br />of the proposed revisions to the B-3 District at the next meeting of the Planning and Zoning <br />Commission.
