CASE # q <br /> <br />PROPOSED ORDINANCE AMENDING RAMSEY CITY CODE CHAPTER 9 <br />SECTION 9.11.02 SUBDIVISION 2, ACCESSORY USES <br /> By: James Gromberg, Project Manager <br /> <br />Background: <br /> <br />City Staff has been reviewing sections of the Ramsey City Code as the City completes its <br />codification process. It has become apparent that certain parts of the City Code need to be <br />changed, updated or made to conform to other sections of City Code. One of these sections is <br />section 9.11.02 Accessory Uses, Subdivision 2 which currently reads as follows: <br /> <br />"The exterior storage of not more than one automobile which does not have a current <br />license plate shall be considered an accessory use, but two or more shall be constituted as <br />an auto salvage business and shall not be permitted as an accessory use." <br /> <br />This compares to Chapter 5.12 Condition of Premises, Item A, which states: <br /> <br />"In any area zoned for residential purposes, storage upon property of junk automobiles...". <br />For the purpose of this section, the term "junk automobile" shall include any motor vehicle, <br />part of motor vehicle or former motor vehicle stored in the open which does not currently <br />have license for use upon the highways of the State or is either... <br /> <br />1. unusable or inoperable because of lack of, or defects in, component parts; or <br /> <br />2. unusable or inoperable because of damage from collision, deterioration, or having been <br /> cannibalized; or <br /> <br />3. beyond repair and therefore not intended for future use as a motor vehicle; or <br /> <br />4. being retained on the property for possible use of salvageable parts. <br /> <br />As Section 9.11.02 Accessory Uses, Subdivision 2, specifically contradicts Section 5.12 of the <br />Ramsey City Code, City Staff has prepared the enclosed ordinance amending Section 9.11.02 <br />Accessory Uses, Subdivision 2, to read as follows: <br /> <br />The exterior storage of one or more automobiles which does not have a current license plate <br />shall constitute a vehicle wrecking yard and shall not be permitted as an accessory use. The <br />showing for sale of not more than one automobile shall be considered an accessory use in <br />any zoning district not zoned for motor vehicle sales. Two or more vehicles shall constitute <br />an auto sales business and shall not be permitted as an accessory use. <br /> <br />This change to the Ramsey City Code alleviates the following problems: <br /> <br />1) Auto salvage business is not defined in the Ramsey City Code and a vehicle wrecking yard <br /> is defined. <br /> <br />2) <br /> <br />The City has received complaints by property owners with regard to the number of vehicles <br />shown for sale at residences in the City. It is not the intent of the City to prevent someone <br />from selling an extra car they may have, but it does not intend to allow private residences to <br />become used car lots. <br /> <br /> <br />
