I <br /> I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />CASE <br /> <br />DISCUSSION REGARDING PROPOSED ORDINANCE TO MOVE <br /> STRUCTURES INTO AND WITHIN THE CITY OF <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />It was brought to the attention of the Planning Commission and City Council that there currently is <br />no established policy or code requirements for obtaining approval to move structures into and <br />within the City of Ramsey. Historically, the unwritten policy has been to charge the applicant <br />$100.00 to cover the cost of the Building Official's inspection of the structures to be moved into <br />Ramsey. Following that, the requests have either been brought directly to Council for approval; or <br />sometimes they are reviewed by both the Planning and Zoning Commission and the City Council; <br />sometimes there was a public hearing; sometimes findings of fact are adopted; and generally there <br />was some sort of agreement entered into by the applicant and the City. Upon approval of the <br />structures to be moved in, the applicant must then obtain a building permit just as if the project <br />were new construction. <br /> <br />Based on the practice in some of the surrounding communities, Staff and the Planning <br />Commission drafted an ordinance whereby requests to move in structures would be approved at a <br />Staff level and in the case of homes, a $3,000.00 financial guarantee would be required to ensure <br />proper completion of the project. <br /> <br />Observations: <br /> <br />This proposed ordinance failed to achieve Council introduction. City Council is concerned that <br />there are no provisions in the ordinance for an architectural review that would ensure that the <br />structure to be moved in is compatible with existing structures in the neighborhood, and that <br />possibly the moving of structures into the City's urban district should be prohibited altogether. <br />The issue was sent back to the Planning Commission for further review and consideration. The <br />Planning Commission directed City Staff to draft an ordinance amendment for Council <br />consideration that would absolutely prohibit the moving of structures into and within the entire City <br />of Ramsey. <br /> <br />For your review and discussion purposes, the most recent version of the draft ordinance is <br />enclosed. <br /> <br />Recommendation: <br /> <br />City Staff reql~ests that there be some one-on-one discussion of this issue to be sure that absolute <br />prohibition is what Council is looking for when they returned the matter to the Commission for <br />further revieW. <br /> <br />Action: <br /> <br />Will be based on your discussion. <br /> <br />Review Cheeldist: <br />CC/PZ: <br /> <br />City Administrator <br />6/29/93 <br /> <br /> <br />
