I
I
I
I
I
I
I
I
I
I
I
I
!
I
I
I
I
I
I

CASE

PROPOSED ORDINANCE TO REDUCE THE SIDE YARD SETBACK
REQUIREMENT IN THE R-1 URBAN RESIDENTIAL DISTRICT
By: Zoning Administrator Sylvia Frolik

Background:

Last month rt~e developers of Amber Ridge approached City Council regarding a hardship they
were encoUntering in meeting the 10 foot side yard setbacks. They explained that the market
demand is fo~ homes with triple attached garages and they cannot construct those styles of homes
on an average urban lot in Ramsey and simultaneously maintain the 10 foot side yard setback on
both sides of rthe property and the architectural integrity of the home. The Council directed that the
Board of Adjt~stment conduct a special meeting to consider a four (4) foot variance to the side yard
setback on th~ garage side for the lots in Amber Ridge. The Council also directed that the Planning
and Zoning Commission initiate action to reduce the side yard setback on the garage side from ten
(10) feet to six (6) feet.

At it's special meeting on June 7, the Board of Adjustment directed the Zoning Administrator to
have a proposed ordinance amendment on the regular Planning and Zoning Agenda for July. The
proposed ordinance is enclosed for your review.

Observations:

Staff did research side yard setbacks in other communities. Andover, Anoka, Blaine, Champlin
and Coon RaPids all have 5 foot setbacks on the garage side; Elk River has a 6 foot setback on the
garage side. Ramsey's Building Official recommends a 6 foot side yard setback on the garage side
to avoid consmaetion right on the line of the standard 5 foot wide utility easements along side
property lines.

Recommendation:

City Staff recommends reducing the side yard setback to six feet for the uninhabitable portions of
structures.

Commission Action:

Motion to:
RecOmmend that City Council adopt Ordinance ¢/03-
the uninhabitable side of the property to six (6) feet.

__ reducing the side yard setback on

Review Checklist:

P&Z:

City Administrator
Building Official

7/6/93
