I <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE <br /> <br />REQUESTiFOR A CONDITIONAL USE PERMIT TO HAVE A HORSE ON LESS <br />THAN THREE (3) ACRES; CASE OF CARRIE OLSON <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Unaware of City Code requirements regarding the maintenance of horses, Carrie Olson brought a <br />horse onto he~ property at 15811 Okapi Street N.W. The situation was brought to the attention of <br />the City's C0~,e Enforcement staff and Ms. Olson was notified that she must have a conditional use <br />permit in ord~ to keep a horse on less than 3 acres. <br /> <br />On July 30, 1993, Carrie Olson applied for a conditional use permit to maintain a horse on less <br />than 3 acres. <br /> <br />On September 21, 1993, the Horse Care Board reviewed the case and recommended approval of <br />the request. <br /> <br />On October 5; 1993, a public hearing regarding the request was scheduled before the Planning and <br />Zoning Commission. <br /> <br />Observations: <br /> <br />Carrie's proPerty is approximately 2.4 acres in size and is located in the R-1 Rural Residential <br />zone. <br /> <br />Section 5.09.04 of the Ramsey City Code states that no stable or barn that houses horses may be <br />located withifi 50 feet of a place of human habitation or within 75 feet of property lines. Carrie's <br />horse is stabi&l in a 8'x9' (72 square foot) mn-in shed located 150 feet from the house and 52 feet <br />from the near~st property line. The run-in shed is considered non-conforming because it is the <br />structure providing shelter to the animal and it is not 75 feet from property lines. It should be <br />noted that beOause of the unique shape of the Olson property, they are limited to constructing a <br />horse shelter a maximum of 15 feet wide, in the middle of the yard, approximately 50 feet from the <br />house in order: to comply with the 75 foot setback from all property lines. <br /> <br />There is a 12' x I6' shed adjacent to the mn-in shed and fenced pasture that is used to store horse <br />feed and equi~me,nt and other miscellaneous personal equipment. This structure does meet the side <br />yard setback ~fequtrement, however, the exterior facing f'mish on the shed is tarpaper which is not <br />in compliance with City Code. The Olson's do have to complete the structure with an exterior <br />finish that con, plies with City Code. <br /> <br />The fenced in pasture area is approximately 1.1 acres in size. ff the roaming area exceeds 1/2 acre <br />per horse, City Code exempts the property from the requirements for a manure storage area and <br />weekly disposal of manure. At the meeting of the Horse Care Board, the Applicant mentioned that <br />several neighi~s have requested using the manure to fertilize their yards and gardens; the balance <br />of the manure;is dispersed on the Olson property for the same uses. The Horse Care Board has <br />recommended',that winter accumulations of manure be dispersed by May 1 of each year. <br /> <br />The fencing consists of 3 strands, 1 wire and 2 barbed wire. <br /> <br /> <br />
