CASE <br /> <br />REVIEW TERMS OF VARIANCE GRANTED TO MR. JAMES McCHESNEY <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you may recall, on September 7, 1993, the Board of Adjustment granted Mr. James <br />McChesney a variance to construct an accessory structure nearer the front property line than the <br />principal structure at 15429 Sunfish Lake Blvd. N.W. During the discussion of the variance, them <br />was some dispute as to the location of the common property line between Mr. MeChesney and his <br />neighbor to the south. Consequently, the Board also granted a 5 foot variance to the 10 foot side <br />yard setback on the south property line. <br /> <br />Observations: <br /> <br />Upon having the property surveyed, it has been determined that one comer of the accessory <br />structure will be 4.5 feet from the side property line and the other comer is 3 feet from the side <br />property line. In accordance with the instructions of the Board of Adjustment, Mr. MeChesney is <br />coming back for direction as to how to proceed when the 5 foot side yard variance is not sufficient <br />to address the snmcture location. Normally, it would not be a problem to relocate a proposed <br />structure but in this case, the accessory structure is a rebuild of a former structure and consequently <br />a substantial amount of framing is already in place. <br /> <br />City Staff is bringing this issue before the Planning Commission for some discussion and direction <br />at this time because it is not known when the Board of Adjustment will be meeting again. Mr. <br />McChesney would like some idea of what he has to do in order to construct the building this <br />spring.
