CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ESTABLISH AND <br />OPERATE A SELF-SERVICE STORAGE FACILITY IN THE B-3 HIGHWAY <br />BUSINESS DISTRICT; CASE OF WILLIAM DUBATS <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Self-service storage facilities are not a specifically permitted use in the B-3 Highway Business <br />District. Accordingly, William Dubats has applied for a conditional use permit to establish and <br />operate self-service storage facilities on Lot 3, Block 3, Riverside West. <br /> <br />Observations: <br /> <br />This development would be an expansion of the self-service storage facilities existing on Lots 1 <br />and 2 of Riverside West, for which conditional use permits were issued in 1986 and 1987. <br /> <br />The property to the north and east is zoned B-3 Highway Business; the property to the south and <br />west is zoned residential. The applicant would have to provide screening along the south and east <br />property lines. City Staff is recommending the planting of trees every 10 feet in a triangular <br />formation, and that two out of every three trees be Spruce or Pine to provide year around <br />screening. <br /> <br />The property is in the Critical River Overlay District and is restricted to a 30% impervious surface <br />area which includes structures and pavement. The site plan proposes approximately 90% <br />impervious surface area. A variance has been properly applied for. The variance is subject to a <br />review by the Department of Natural Resources (DNR) and the Environmental Quality Board <br />(EQB) and certification by the Commissioner of DNR. For the record, a variance was granted in <br />1986 for Lot 2 to be developed with an 85% impervious surface area. <br /> <br />The City has received a letter from Terry and Tara Goodwin, occupants of the adjacent residential <br />parcel to the south, stating their support of the request. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />d) <br />e) <br /> <br />Site location map <br />Site plan and supporting documentation <br />Letter from Terry and Tara Goodwin received by the City on 2/23/94 in support of <br />the request <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Recommendation: <br /> <br />As mentioned earlier, Mr. Dubats has applied for a variance to the 30% impervious surface area <br />restriction. Approval of the conditional use permit should be contingent upon a favorable variance <br />decision, as certified by the Commissioner of DNR. The issue of the conditional use permit has <br />also been forwarded to DNR for review. <br /> <br /> <br />
