Modification to the grading plan <br />Assistant Public Works Director Olson stated regarding the modification to the grading plan, at <br />the last meeting there was discussion about a pond in the back yard of a residential property that <br />was constructed in the mid 1990's. The discussion was basically that it was a deficiency in the <br />current standard. Whereas that is true, it was not a deficiency when it was put in. The rules <br />regarding the fi'eeboard have changed from one feet to two feet of clear zone between the 100 <br />year event m~d the low floor elevation. There is currently 1.8 feet, and the development proposal <br />suggested putting water into the pond and worsening a situation by increasing the water level to <br />1.6 feet away from the low floor elevation. Staff does not agree that is allowable. What he <br />would suggest is to modify the grading plan to increase the size of the pond that is currently <br />proposed. <br /> <br />Mr. Schmidt indicated City code requires curb around all asphalt areas, and he would like not to <br />put curb on the westerly side so the water can filter off the asphalt onto the grass. <br /> <br />Assistm~t Public Works Director Olson expressed concern in getting away from the curbing, as <br />the water should be directed into the storm sewer. <br /> <br />The consensus of the Council was to direct staff to proceed with the Assistant Public Work <br />Director's suggestions. <br /> <br />3) Rental Housing <br /> <br />Associate Planner Geisler reviewed that at the last Council meeting, the Council directed staff to <br />placc a general rental housing topic on a worksession agenda for discussion. She presented the <br />Council with infonnation regarding the rental units in the City. She indicated there are 156 rental <br />units in the City at 2.6 percent of the total housing units. In 2004 there were 135 rental licenses <br />issued and there are currently 9 rental conditional use permits in the City. <br /> <br />Councilmember Cook stated he does not see any problem with letting these people rent if having <br />a dual rental property does not cause the capability for building other duplexes in a single family <br />area. In addition, there are already 156 rental properties in the City, with only a possibility of <br />nine more situations like this. He stated people have the idea that renters take less care of their <br />property than owners. There are houses by his home that people have lived in for 17 years and <br />never put a speck of paint on or improved. Someone that abuses their property abuses it whether <br />they are renting or not. <br /> <br />Councilmember Elvig inquired about controls on people splitting their homes internally and <br />leasing out part of the home. <br /> <br />Community Development Director Frolik replied most of the 9 properties with conditional use <br />permits converted their lower or upper level to a separate self-sustaining living area.
