Councihnember Pearson questioned ifD.R. Horton and NAU knew the assessments were not all <br />ironed out when they purchased the property. <br /> <br />Mr. Feges explained the Development Agreement calls out that the City subjectively may ask for <br />a special service district, but never stated a dollar amount. It was not specifically called out that <br />it would be an impact today, but it was there. The problem is with the special service district. <br />They anticipated dividing the cost over 322 acres, however, state statute restricts it from any <br />residential properties, making a stronger burden on the commercial property. <br /> <br />Mayor Gamec directed staff to put together information for the Council to show the decisions <br />that need to be made. He stated the Council needs to know what the obstacles and choices are to <br />make a decision. If the developer does not agree they can go by the original agreement, although <br />he does not think that is what anyone wants to do. He stated the Council is here to protect the <br />interest of the citizens in the City of Ramsey and they want to feel secure that they are doing that. <br /> <br />Councilmember Zimmerman asked if any of the AUAR funds have been used yet on Ramsey <br />Boulevard. <br /> <br />Assistant Public Works Director Olson replied the funding for the first phase of Ramsey <br />Boulevard improvements came from MSA funds and utility funds. <br /> <br />Councilmember Zimmerman questioned why the developer cannot sell the land, rather than the <br />City giving up the 4.5 million dollars in AUAR funds in exchange for the land. <br /> <br />City Administrator Norman replied it is drafted that way under the Master Development <br />Agreement. <br /> <br />Councilmember Cook stated the land is the surety that the City wants. <br /> <br />The consensus of the Council was to direct staff to put together information for the Council <br />showing the decisions that need to be made, with the attorneys to be present at the meeting where <br />the situation is discussed. <br /> <br />Mr. Feges stated the gap financing has been solved. RTC definitely wants to get this resolved, as <br />it impacts how they are marketing and selling.
