<br /> DINANCE AMENDING CERTAIN
<br /> TIONS OF THE RAMSEY CITY
<br /> CHARTER.
<br /> City of Ramsey ordains:
<br /> TION 1. M~_M~.~O_MENT
<br />,division 1. Section 3.1 of the City
<br />is amended to provide as follows:

<br />ubd. 4. Section 5.2 of the City
<br />Ler is amended to provide as follows:

<br /> Subd. 6. Section 5.8 of the City
<br /> Charter is amended to provide as follows:
<br /> Section 5.8 Recall. Conside!'ation by
<br /> the electorate of the recall of any~elected
<br /> officer of the city may be Imt~ated by pcb-
<br /> tion. The petition shall state at the head
<br /> of each page, or attache_d thereto, acer,
<br /> tificate stating the name of the officer
<br /> whose removal is sought, the grounds for
<br /> recall, which shall be malfeasance, mis-
<br /> feasance or nonfeasance in office, is not
<br /> more than 2.50 words, and the intention
<br />· of the sponsoring committee to bring
<br /> about the officer's recall. Such petition
<br /> shall be filed ih the city clerk's office prior
<br /> to circulation. If the petition or amended
<br /> petition is found sufficient under the pro-
<br /> visions of Section 5.3 of this chapter, the'
<br /> city clerk shall transmit it to the;council
<br /> without delay, and shall also Officially
<br /> notify the person sought to be recalled of
<br /> the sufficiency of the petition and of the
<br /> pending action. The council shall, at its
<br /> next meeting, by resolution, provide for
<br /> the holding of a special recall election
<br /> within ninety days after such meeting,
<br /> the council may, in its discretio~'Progide
<br /> for the holding of the recall ~0~e a~;~hat
<br /> time. If the spec!al recall electiqfi'involves
<br /> a councilmember elected from a separate
<br /> Ward, the special recall election shall be
<br /> conducted only within the Ward of such
<br /> councilmember. If the special recall elec-
<br /> tion involves the mayor or a coundlmem-
<br /> bet who is elected at large, the election
<br /> shall be a city-wide election. The city
<br /> clerk shall include with the published
<br /> notice Of the. election the statement of
<br /> the grounds for the recall and, also, in
<br /> not more than S00 words, the answer of
<br /> the officer concerned in justification of
<br /> his/her course of office. If a vacancy
<br /> occurs due to recall election, section 4.5
<br /> shall apply to fill such vacancy.
<br /> SECTION 2. EFFECTIVE DATE
<br /> The effective date of this ordinance is
<br /> ninety (90) days after its passage and
<br /> publication, subject to Minn. Stat.
<br /> §410.12, Subd. 7.
<br /> The amendments become necessary
<br /> as a result of the Charter amendments
<br /> increasing the Council' size;to seven
<br /> members and adoption of[the Ward
<br /> System,
<br /> All interested persons ar~ invited to
<br /> attend th'e hearing and comment on the
<br /> proposed Charter amendment. The City
<br /> of Ramsey complies with the Americans
<br /> with Disabilities Act and, upon advance
