<br />Councilmember Riley introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #17-10-278 <br /> <br /> <br />RESOLUTION APPROVING DRAINAGE AND UTILITY EASEMENT <br />ENCROACHMENTS FOR EAVE OVERHANGS IN THE RIVERSTONE SUBDIVISION <br /> <br /> <br />WHEREAS, <br />Capstone Homes hereafter referred to as “Developer”, has requested a one <br />(1) foot drainage and utility easement encroachment for the Riverstone subdivision; and <br /> <br />WHEREAS, <br />the City Engineer has stated that the impacted drainage and utility easements <br />will still properly function with said encroachment; and <br /> <br />WHEREAS, <br />no portion of the structure other than the eave overhang shall encroach within <br />the easement; and <br /> <br />WHEREAS, <br />the City plans on amending its design standards for lots smaller than 10,800 <br />square feet to require a four (4) foot drainage and utility easement and a five (5) foot minimum <br />side yard setback to avoid this situation in the future. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY , STATE OF MINNESOTA, as follows: <br /> <br /> <br />That the Ramsey City Council hereby approves of the drainage and utility easement encroachment <br />of one (1) foot for eave overhangs only for the first phase of the Riverstone subdivision. <br />a. Future phases of the Riverstone subdivision shall incorporate a four (4) foot side yard <br />drainage and utility easement and shall have a minimum side yard setback of five (5) feet. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Kuzma, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Strommen <br /> Councilmember Riley <br /> Councilmember Kuzma <br /> Councilmember Johns <br /> Councilmember LeTourneau <br /> Councilmember Shryock <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br />and the following abstained: <br /> <br /> None <br /> <br />and the following were absent: <br /> <br /> Existing Vacancy <br /> <br />
