Councilmember Riley introduced the following resolution and moved for its adoption: RESOLUTION #17-10-278 RESOLUTION APPROVING DRAINAGE AND UTILITY EASEMENT ENCROACHMENTS FOR EAVE OVERHANGS IN THE RIVERSTONE SUBDIVISION WHEREAS, Capstone Homes hereafter referred to as “Developer”, has requested a one (1) foot drainage and utility easement encroachment for the Riverstone subdivision; and WHEREAS, the City Engineer has stated that the impacted drainage and utility easements will still properly function with said encroachment; and WHEREAS, no portion of the structure other than the eave overhang shall encroach within the easement; and WHEREAS, the City plans on amending its design standards for lots smaller than 10,800 square feet to require a four (4) foot drainage and utility easement and a five (5) foot minimum side yard setback to avoid this situation in the future. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY , STATE OF MINNESOTA, as follows: That the Ramsey City Council hereby approves of the drainage and utility easement encroachment of one (1) foot for eave overhangs only for the first phase of the Riverstone subdivision. a. Future phases of the Riverstone subdivision shall incorporate a four (4) foot side yard drainage and utility easement and shall have a minimum side yard setback of five (5) feet. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Kuzma, and upon vote being taken thereon, the following voted in favor thereof: Mayor Strommen Councilmember Riley Councilmember Kuzma Councilmember Johns Councilmember LeTourneau Councilmember Shryock and the following voted against the same: None and the following abstained: None and the following were absent: Existing Vacancy
