Building Official that authorizes the structure to be used for its intended <br />purposes. <br />1. Financial Guarantee for Condition of Bowers Drive. The DEVELOPER <br />shall provide a separate financial guarantee, in the form of an irrevocable <br />Letter of Credit or a Cash Escrow in the amount of Fifty Thousand Dollars <br />and No Cents ($50,000.00), to the CITY guaranteeing that the post - <br />construction condition of Bowers Drive is the same or will be restored to <br />the same as the pre -construction condition. The financial guarantee shall <br />be provided prior to the commencement of any work on the Subject <br />Property. <br />The DEVELPER and the CITY shall have an on -site meeting to review the <br />existing condition of the road prior to commencement of any construction <br />activity. Partial reductions of this financial guarantee may be requested by <br />the DEVELOPER, subject to the approval of the CITY, as Certificates of <br />Occupancy are issued within the Plat. The PERMITTEE shall request an <br />on -site meeting with the CITY to review the post -construction condition of <br />the road prior to final release of the financial guarantee. <br />m. Notices.
