City Attorney Goodrich replied that the Council would need to adopt findings of fact and then <br />introduce the ordinance and then adopt the ordinance on a 3/5% vote after the Met Council <br />approves the Comprehensive Plan Amendment. <br /> <br />Mayor Gamec reviewed findings 8 through 11, <br /> <br />Councihnember Zimmerman felt that the development would change the essential character of <br />the area. <br /> <br />Consensus of the Council was to delete finding #9. <br /> <br />Councilmember Hendriksen stated that the findings are asking if the existing roads can handle <br />the plat and there is no possibility of an access to T.H. #47 and there are no roads to the west of <br />the proposed development so they are limited to 153rd Avenue to the south and they don't <br />typically place them within 300 feet from a major intersection. He did not feel that one access to <br />the development was adequate. <br /> <br />Mayor Gamec replied that the findings pertain to existing road structures not roads within the <br />development. <br /> <br />Councihnember Hendriksen stated that the infrastructure in the area is not adequate because an <br />access is not possible along T.H. #47 and there can only be one access from 153~d Avenue. <br /> <br />Consensus of the Council was to delete finding #10. <br /> <br />Councihnember Anderson encouraged the developer to accommodate more than one access. <br /> <br />Mr. Ebe noted that they are attempting to work with the landowners to the west to connect the <br />development. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Resolution <br />#02-01-022 adoptiug Findings of Fact #0597 relating to a request to rezone the subject property <br />fi'om R-1R Residential, B-1 Business, and B-2 Business to R-3U Multi-Family Residential, as <br />amended. <br /> <br />Further discussion: Councilmember Hendriksen requested clarification that findings #9 and #10 <br />were deleted. Mayor Gamec replied yes. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, and <br />Zimmermau.
