No legally impounded animal shall be released except to the <br />person displaying a receipt from the city clerk showing payment <br />in full for the costs of impounding and care of the animal. If <br />any person, without authority of law, and without first paying <br />the co,ts due, shall take any impounded animal out of the <br />enclosure in which it is impounded, he shall be guilty of ~ <br />misdemeanor. <br /> <br />Costs incurred by the city in impounding horses running at large <br />shall be paid by the owner of the horse prior to releasing said <br />animal · <br /> <br />If any horse impounded is not redeemed within fourteen days, the <br />chief of police or his designated agent shall give an additional <br />three days notice of the time and place where such animal or <br />animals will be sold by posting and serving notices as required <br />for notice herein. If such animal cannot be sold on the day <br />stated, it may be sold as soon as possible thereafter without <br />notice. <br /> <br />The city clerk shall turn over the proceeds of any sale to the <br />city treasurer. On order of the city council, the city treasurer <br />shall pay to the owner of such animal the difference between the <br />sale price, after deducting the cost of impounding, feeding and <br />sales charges, if the owner makes claim for the monies within one <br />year from the date of sale; otherwise, it shall be forfeited to <br />the city. <br /> <br />No person may ride or drive a horse after the hour of sunset and <br />before the hour of sunrise along or crossing any public way <br />without appropriate lighting or reflectorized clothing. <br /> <br />No person may ride or drive a horse in any public park, beach, <br />golf course or other public property except within the right-of- <br />way of public streets and highways and in areas duly designated <br />as a trail or hitching area. <br /> <br />The city park and recreation commission shall designate and <br />properly post those areas in public lands and parks where horses <br />may be ridden. <br /> <br />Every person riding a horse or driving any horse-drawn vehicle <br />upon a public roadway shall be subject to those provisions of the <br />city code applicable to the driver of a motor vehicle, except <br />those provisions which by their nature have no application. <br /> <br />No horse shall be ridden or driven in any manner which would <br />cause undue damage to any hard-surfaced road. <br /> <br />No person shall ride or drive any horse upon private property <br />without the prior written permission of the owner or occupant <br />thereof. <br /> <br /> <br />
