The Board proceeded to review the proposed findings of fact: <br /> <br />Item #7 was amended to indicate that the height of the proposed <br />accessory structure will be 17'6". <br /> <br />Commissioner Holm noted that the Board consistently denies requests for <br />variances to height limitations. <br /> <br />Mr. Jake Barthold noted that the additional height is needed in order to <br />have a building that will accommodate Peter's backhoe and motorhome. <br /> <br />Commissioner Hendriksen noted that the Board has approved height variances <br />when the accessory structure is not proposed to be higher than the <br />principal structure. <br /> <br />Commissioner Holm noted that the Board is only supposed to make adjustments <br />to code requirements when the hardship is something that was not created by <br />the applicant. <br /> <br />Building Official Erickson stated that there is not another truss design <br />that could be used to decrease building height that would meet the snowload <br />requirements for this size of building; even a 16' high building would be <br />higher than the principal s~ructure because the home is earth bermed. <br /> <br />Motion by Commissioner Howell and seconded by Commissioner LaDue to adopt <br />Findings of Fact #0240, as amended, relating to Mr. Peter Barthold's <br />request for a variance. <br /> <br />Motion carried. Voting Yes: Chairman Shumway, Commissioners Zimmerman, <br />Holm, Howell, Terry, Hendriksen and LaDue. Voting No: None. <br /> <br />Motion by Commissioner Howell and seconded by Commissioner LaDue to approve <br />Mr. Peter Barthold's request for a variance. <br /> <br />Further Discussion: The Board proceeded to review the proposed conditions <br />of the variance. <br /> <br />Amendment by Commissioner Terry and seconded by Commissioner Zimmerman to <br />amend the proposed variance as follows: 1) Ail references to 'garage' <br />shall be changed to 'accessory structure'. 2) Item #2 shall specify an <br />accessory structure height of 17'6". <br /> <br />Amendment carried. Voting Yes: Chairman Shumway, Commissioners LaDue, <br />Hendriksen, Howell, Zimmerman, Holm and Terry. Voting No: None. <br /> <br />Motion carried. Voting Yes: <br />Howell, Zimmerman and Terry. <br />Holm. <br /> <br /> Chairman Shumway, Commissioners LaDue, <br />Voting No: Commissioners Hendriksen and <br /> <br />Commissioner Holm noted that one of the conditions for granting a variance <br />is that the hardship is unique and not shared by neighboring properties; he <br /> Board of Adjustment/December 6, 1988 <br /> <br />Page 2 of 3 <br /> <br /> <br />
