Voting No: None. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #1.: <br /> <br />Request to Rezone Property from B-1 Business and R-1 Single Family <br />Residential to R-1 Single Family Residential, R-3U Residential, and Multiple <br />Residential; Case of Royal Oaks Realty <br /> <br />Principal Planner Trudgeon stated that Royal Oaks Realty has submitted an application to rezone <br />property located at the southwest corner of CSAH 5 (Nowthen Boulevard) and Dysprosium <br />Street from B-1 Business and R-1 Single Family Residential to R-1 Single Family Residential, <br />R-3U Residential, and Multiple Residential. The rezoning would allow the property to be <br />subdivided for 88, single-family lots, 91 townhome units and 82 senior apartment units. The <br />property is 86.71 acres in size and is within the Metropolitan Urban Service Area (MUSA). The <br />preliminary plat accompanying the application proposes to develop 88 single-family homes on <br />the western part of the property, 91 townhomes along Nowthen Boulevard, and an 82 unit senior <br />apartment building along Dysprosium Street. The 2001 Comprehensive Plan identifies this area <br />as being High Density Residential along Dysprosium Street, Medium Density Residential along <br />Nowthen Boulevard and Low Density Residential on the western part of the property. The <br />development property is adjacent to property that is zoned R-1 Single Family Residential, with <br />the exception of a parcel north of the development property that is zoned R-3 Urban Residential, <br />and a portion of the Flintwood Hills P.U.D. that is adjacent to the southeast portion of the <br />development property. The Lord of Life Church property lying on the northeast side of Nowthen <br />Boulevard is zoned B~I Business and the Savannah Oaks Senior Apartment Building on the <br />eastern side of Dysprosium is zoned Multiple Residential. Royal Oaks Realty submitted an <br />application in the spring 2001 to rezone the development property to Planned Unit Development <br />(PUD). At the June 26, 2001 City Council meeting, the applicant withdrew the rezoning <br />application. At their January 3, 2002 meeting, the Planning Commission recommended approval <br />of the request for rezoning of the property from B-1 Business and R-1 Single Family Residential <br />to R-1 Single Family Residential, R-3U Multiple Residential, and MR Multiple Residential. <br /> <br />Councilmember Hendriksen inquired as to what the land was designated in the 2001 <br />Comprehensive Plan. <br /> <br />Principal Planner Trudgeon explained that 65.67 gross acres, or 41 net acres, are designated as <br />low density, 13.52 gross acres, or 10.48 net acres, are designated medium density, and 7.52 gross <br />acres or 7.21 net acres, designated as high density. <br /> <br />City Council/February 12, 2002 <br /> Page 5 of 33 <br /> <br /> <br />
