5 Minutes CASE <br /> <br />REQUEST TO VACATE DRAINAGE EASEMENT <br />ON LOT 4, BLOCK 4, NORTHFORK <br /> Case of Mr. Dennis Peck <br /> <br />By: Pete Raatikka, City Engineer <br /> <br />Background: <br /> <br />Mr. Dennis Peck, North Fork Inc., is requesting that a portion of <br />the drainage easement on the front half of Lot 4, Block 4, be <br />vacated to allow for the sale of the lot and house as discussed <br />at your September 27, 1988 Council Meeting. Since that meeting <br />we have reviewed options for the drainage with Mr. Peck and he is <br />willing to construct a swale on Lot 4, Block 4, and a ponding <br />area on Lot 3, Block 4. This ponding is proposed to be <br />constructed to contain runoff from a 100 year storm at an <br />elevation below 876.3. The walkout level is 878.3, which is 2 <br />feet higher than the projected 100 year storm level. <br /> <br />In addition, the staff recommends that the developer enter into a <br />hold harmless agreement with the City. <br /> <br />Enclosed is a sketch of the proposed pond and swale and the <br />revised easement limits, also enclosed is proposed resolution <br />vacating a portion of the easement on Lot 4, Block 4. <br /> <br />Recommendation: <br /> <br />City staff recommends the adoption of Resolution 88-__ which <br />will vacate that portion of the easement shown on the enclosed <br />sketch, said vacation should be contingent upon certain <br />conditions as described in the attached resolution. The vacation <br />will provide for the construction of the swale and ponding area <br />and the dedication of a new easement on Lot 3, Block 4. <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution 88- vacating a portion of the <br />easement on Lot 4, Block 4, and providing for the construction of <br />a swale and ponding area on Lot 3, Block 4. <br /> <br />Review Checklist: <br /> <br />Administrator X <br />Attorney X <br />Engineer X <br />Comm.
