5 Minutes Case ~. 6 REQUEST TO VACATE DRAINAGE EASEMENTS ON LOTS 3 & 4, BLOCK 3, WOODLAND GREEN Case of Mr. Glen Hammerschmidt By: Pete Raatikka, City Engineer Background: Mr. Glen Hammerschmidt and Mr. Brock Hammerschmidt are requesting that the city vacate the northerly 50 feet of a 75 feet wide drainage easement on Lots 3 and 4, Block 3, Woodland Green. The reason for the request on Lot 4 is to allow for the building of a house at the north boundary of the existing easement. As shown on the attached survey, Mr. Hammerschmidt is proposing to set the house 4 to 5 feet above the existing ground and proposes to fill in part of the easement to provide a movable slope. Without the vacation of the easement, no filling would be allowed. The reason for the request on vacating the easement on Lot 3 is to provide a consistent easement limit over Lots 3 and 4. Based on our review, the proposed vacation of the easments would not affect the drainage in the area. Enclosed is a sketch plan of Lot 4, certificate of surveys on Lots 3 and 4, proposed findings of fact and proposed resolution vacating the north 50 feet of the drainage easements. Recommendation: I would recommend that the City Council vacate the north 50 feet of the drainage easements based on the findings of fact.
