10 Minutes Case # 8 <br /> <br />AUTHORIZE RIGHT-OF-WAY ACQUISITION, <br /> ORDER PLANS AND SPECIFICATIONS AND <br /> APPROVE NO PARKING RESOLUTION <br /> 153RD AVENUE N.W. <br /> By: Pete Raatikka, City Engineer <br /> <br />Background: <br /> <br />Mn/DOT has approved the right-of-way plans for 153rd Avenue N.W. <br />between Andrie Street and T.H. No. 10 & 169. Approval of the plans <br />was contingent on receipt of a no parking resolution. <br /> <br />To proceed with the project, the City should pass a no parking <br />resolution, authorize the City Attorney to acquire the right-of-way by <br />direct negotiation or condemnation and ordering preparation of plans <br />and specifications. <br /> <br />Enclosed is a copy of the letter from Mn/DOT dated September 30, 1988 <br />approving the right-of-way plans, a no parking resolution, a <br />resolution authorizing acquisition of right-of-way and a resolution <br />ordering plans and specifications. <br /> <br />Recommendation: <br /> <br />Since the City has received an order from Mn/DOT to establish a public <br />highway railroad crossing over the Burlington Northern Railroad and <br />since it is proposed to construct the project using MSA funds with no <br />assessments to the abutting property owners, no additional studies are <br />required. Therefore, I recommend that the council adopt the proposed <br />resolutions. <br /> <br />Council Action: <br /> <br />Motion to: <br />Adopt Resolution ~ <br /> ~88-~ relating to parking restrictions on 153rd <br />Avenue (S.A.P. 199-112-02). <br /> <br />Idotion to: <br />Adopt Resolution ~88-~ authorizing the City Attorney to acquire the <br />right-of-way for the project by direct negotiation or eminent domain. <br /> <br />Motion to: <br />Adopt Resolution ~88- authorizing the City Engineer to prepare <br />plans and specifications for Street Improvement Project ~88-21 (153rd <br />Avenue N.W.) <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Comm.
